Report to Council Re: DVP Application 2022/03 – 2446 Lund Road
A staff report recommending the approval of a Development Variance Permit for a patio cover at 2446 Lund Road with specific conditions regarding its structure.
DISCUSSION:
A patio cover was installed earlier this year without a building permit. A drainpipe was installed to divert roof runoff from the patio cover into the perimeter drain. The patio cover eventually collapsed under snow load. If the variance is approved, a building permit with engineered plans will be required.
Patio covers provide shelter from rain and sun. It should be noted that an accessory building or structure (such as a detached patio cover) must be sited 3.0m from the principal building but can be sited 0m from a side or a rear lot line in this zone.
The plans presented at the July 12, 2022 Committee of the Whole meeting showed enclosures and it was unclear if the maximum floor space ratio of 0.45:1 would be exceeded, as the floor space ratio of the existing house is 0.34:1. It has now been clarified that the patio cover will not have fixed walls, but the intention is for some roll down covers for seasonal wind blocking – this temporary type arrangement is not defined as floor space. It is recommended that the permit include a condition that no fixed walls, windows, or doors be permitted as part of the structure.
It will be Council’s prerogative to:
- approve the requested variance to the rear yard setback from 6.0m to 2.1m;
- reject it; or
- approve a different variance to the rear yard setback.
The application can be supported in this case because:
- The patio cover, being attached to the principal dwelling, would comply with the required side yard setback of 1.2m. In this zone, an accessory building or structure can be located 0m from a rear lot line and 0m from a side lot line, so the proposal would be less intrusive on neighbouring properties.
- The patio cover would not cover the entire paved area of the patio.
- 26% of this parcel is greenspace where 20% minimum is required.
- Rainwater would be diverted from the patio cover into a perimeter drain.
RECOMMENDATION:
THAT Development Variance Permit 2022/03 be approved as per the report dated August 31, 2022 from the Senior Planner titled “Development Variance Permit Application 2022/03 - 2446 Lund Road”;
AND THAT Development Variance Permit 2022/03 include the following variance:
- Variance to the requirement within Section 12.5.6 of Zoning Bylaw No. 900, 2014 from 6.0m to 2.1m.
AND FURTHER THAT Development Variance Permit 2022/03 include the following condition:
- Fixed walls, doors and windows are not permitted.
