Attachment 11 - Unsafe to Occupy Notice

RE: Unsafe to Occupy Single-Family Dwelling at 12 Vickery Road

This letter is to inform you that the single-family dwelling located at 12 Vickery Road is currently deemed unsafe for occupancy. The building permit has expired and no final inspection notice or an occupancy permit has been issued by the Town’s Building Inspector for the building. A final inspection notice could not be issued due to non-compliance with sections 5.2, 18.4 and 24.8 of Building Bylaw No. 1111, as follows:

Unsafe to Occupy means a building or construction that has been declared to be structurally unsafe by the Building Official and the Chief Administration Officer of the Town

PART 5: PROHIBITIONS

5.2 A person must not occupy or permit the occupancy of any building or structure or part of any building or structure

a) unless a subsisting final inspection notice or an occupancy permit has been issued by a Building Official for the building or structure or the part of the building or structure; or b) contrary to the terms of any permit issued or any notice given by a Building Official.

PART 18: OCCUPANCY

18.4 For all buildings, a final inspection notice will not be issued unless:

a) all letters of assurance have been submitted when required in accordance with this Bylaw;

PART 24: BUILDING OFFICIAL’S NOTICES

24.8 The owner of a property on which a Do Not Occupy notice or an Unsafe to Occupy notice has been posted, and every other person, shall cease occupancy of the building or structure immediately and shall refrain from further occupancy until all applicable provisions of this Bylaw, the Building Code and any other applicable bylaw have been substantially complied with, and the Do Not Occupy notice or Unsafe to Occupy notice has been rescinded in writing by a Building Official.
