DEVELOPMENT VARIANCE PERMIT 2025-01 – 21 TOVEY CRESCENT
RECOMMENDATION:
THAT Council authorize the issuance of Development Variance Permit No. 2025-01 for 21 Tovey Crescent, subject to the proposed development meeting all of the Town’s Zoning Bylaw requirements, except for the following variance:
- decrease the minimum lot size of a Level 3 Home Occupation from 1,000m² to 995m² to permit a Bed and Breakfast.
ALTERNATIVES:
That Council decline Development Variance Permit Application No. 2025-01 for 21 Tovey Crescent.
PURPOSE:
To consider Development Variance Permit Application (DVP) No. 2025-01 for 21 Tovey Crescent to reduce the minimum lot size of a Level 3 Home Occupation from 1,000m² to 995m² to permit a Bed and Breakfast on the subject property.
DEVELOPMENT APPLICATION PROCESS
Figure 1 below outlines the DVP application process. The red star identifies where the application is currently within the process – before Council for consideration.

BACKGROUND:
The proposal was introduced at the Council meeting on June 3, 2025. The associated staff report is provided as Attachment 1. At that June 3 meeting, Council passed the following motion:
THAT staff proceed with the public notification process for Development Variance Permit No. 2025-01 for 21 Tovey Crescent, subject to:
a. Proposed development meeting all of the Town’s Zoning Bylaw requirements, except for the following variance:
i. decrease the minimum lot size of a Level 3 Home Occupation from 1,000m² to 995m² to permit a Bed and Breakfast.(C-97-25)
ANALYSIS:
Notice of this meeting to consider this application was made in accordance with Development Procedures Bylaw No.730, 2009. Staff recommend that Council authorize the issuance of Development Variance Permit (DVP) No. 2025-01.
