1. CALL TO ORDER – Councillor Rogers, Acting Chair, called the meeting to order at 7:03 p.m.
The Acting Chair acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

5. PETITIONS & DELEGATIONS
a) C. Mossey, Senior Manager, Government Relations, BC Transit, Re: Update from BC Transit
Ms. Mossey gave a BC Transit update to Council, regarding:
- Transit Future Plan;
- West Shore transit network restructure;
- future service expansion;
- Island Highway – West Shore RapidBus improvements;
- bus shelter program;
- handyDART facility;
- electronic fare collection system (Umo) and fare review;
- NextRide service; and
- low carbon fleet program.
Council and Ms. Mossey discussed ridership rates, service cancellations, RapidBus project, changes to routes to avoid full buses, and additional buses to meet ridership rates.
b) T. Stevens, McElhanney Ltd., Re: Highway 1 Bus on Shoulder – Helmcken to Colwood Project
Mr. Stevens gave an update to Council on the Highway 1 Bus on Shoulder, Helmcken to Colwood Project, specifically scope of project and schedule; current status; and potential impacts and concerns to the Town.
Council, Mr. Stevens and M. Pearson, Ministry of Transportation and Infrastructure, discussed the ramp at Burnside Road West, noise near Portage Park, consideration of sound attenuation wall, wiring for push button crosswalk at the Helmcken Road on-ramp west bound at the Trans-Canada Highway, location of a stop sign in relation to the crosswalk at this on-ramp, and the status of the park and ride by Atkins Road.
6. PUBLIC PARTICIPATION PERIOD
a) L. Pakos, 336 Glenairlie Drive, noted she is not opposed to the development project at 294/296 Eltham Road and 242 Helmcken Road and requested that consideration be given to a left and right turn onto Helmcken Road from Eltham Road. She indicated her belief that there should be two-hour parking provided on Eltham Road and asked where contractors would park during construction.
7. BUSINESS ARISING FROM PREVIOUS MINUTES
a) Modernize the Municipal Police Cost Sharing Formula – Councillors MacKenzie and Rogers

C-18-24 THAT the following resolution be forwarded to the Association of Vancouver Island Coastal Communities 2024 Convention:
"WHEREAS inflation, burnout, rising equipment costs, and an increase number of officers have made the existing cost sharing formula outdated, the new and unexpected rapid growth from the Province’s housing bills (Bill 44 – 2023 Housing Statutes (Residential Development) Amendment Act and Bill 47 – 2023 Housing Statutes (Transit-Oriented Areas) Amendment Act will dramatically escalate policing costs;
AND WHEREAS Bill 46 – 2023 Housing Statutes (Financing Tools) Amendment Act that broadens the scope of infrastructure eligible to be funded through Development Cost Charges to now include police facilities is insufficient to address the already over-capacity police facilities;
THEREFORE BE IT RESOLVED THAT the Province modernize the municipal police cost sharing formulas with the following revisions:
- From municipalities with populations of:
- less than 5,000 contributing 30%;
- 5,000 to less than 15,000 contributing 70%; and
- 15,000 or more contributing 90%;
- To municipalities with populations of:
- less than 5,000 contributing 30%;
- 5,000 to less than 10,000 contributing 50%;
- 10,000 to less than 20,000 contributing 70%;
- 20,000 to less than 40,000 contributing 80%; and
- 40,000 or more contributing 90%;
AND BE IT FURTHER RESOLVED THAT the above modernization be effective before the 2026 federal census.” CARRIED

C-19-24 THAT the Town of View Royal make application from the 2024 Union of British Columbia Municipalities (UBCM) Community Emergency Preparedness Fund (CEPF) for an Emergency Social Services grant in support of the View Royal and Colwood ESS Team in the amount of $30,000. CARRIED

10. BYLAWS
a) Bylaw No. 1130 – Rezoning of 294 and 296 Eltham Road and 242 Helmcken Road
- Report dated February 1, 2024 from the Senior Planner
The Senior Planner gave a summary of the report to Council.
Council discussed setbacks, tree preservation, impact to adjacent property, parking, access and egress, traffic impact, and potential commercial use.
Council and the applicant, D. Martin, discussed tree protection, parking, and consideration of commercial space.
The Senior Planner confirmed that the Official Community Plan only supports commercial uses for the south side of Eltham Road, across the street from the proposed development site.

C-20-24 THAT legal agreements be registered on the titles of 294 and 296 Eltham Road and 242 Helmcken Road prior to final reading of Zoning Bylaw No. 900, 20104, Amendment Bylaw No. 1130, 2024 to secure the following items, prior to issuance of a building permit:
- a community amenity contribution of $4,000 per dwelling unit;
- no individual sale of any of the three subject properties, in order to preserve the three subject properties as one development site;
- lot consolidation of the three subject properties; and
- a 3m x 3m road dedication at the Eltham Road/Helmcken Road intersection. CARRIED

THAT the above recommendation be amended to include:
- the addition of a left out turn lane onto Helmcken Road from Eltham Road. DEFEATED Councillors Brown, Kowalewich and MacKenzie opposed
b) Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1130, 2024 A Bylaw to Amend the Zoning Bylaw with Respect to Creating the CD-29 Comprehensive Development (Eltham Road Townhouse) Zone and with Respect to the Rezoning of 294 and 296 Eltham Road and 242 Helmcken Road

a) Budget Survey – Greater Victoria Public Library and West Shore Parks and Recreation Society – Councillor MacKenzie

C-21-24 THAT the Town’s 2024 Citizen Budget Engagement opportunity include questions about satisfaction levels with the Greater Victoria Public Library and West Shore Parks and Recreation services. CARRIED
b) Easterly Portion of 80 Atkins Road – Councillor Rogers
Councillor Rogers noted he feels the easterly portion of 80 Atkins Road would be a good location for an off-leash dog park.

C-22-24 THAT the easterly portion of 80 Atkins Road not be reinstated as a parking lot, but instead that its use as an off-leash dog park be considered during the 2024 budget deliberations;
AND THAT should new funding not be allocated, that a sufficient portion of the proposed Chilco Park capital improvements be reallocated to creating this off-leash park in 2025. CARRIED Councillor MacKenzie opposed
