Dear Mr. Mayor and Council members,
As we stated in our original letter to you in late December, we (David Vincent Overton and Angela Caroline Wiggins) of 305 Anya Court, along with our agent, Borden Kurylo, are proposing a one-level Detached Accessory Building — Garage (2 cars) + Garden Shed — of 7.5m x 7.5m maximum dimensions and 48.15m² area, which conforms to OCP uses. Because our lot is reduced from useable large lot area by the very substantial rear Restrictive Covenant and topography, the proposed Garage/Shed is shown proximate to the Single Family Dwelling (SFD), yet allows Rear Yard access at the separation.
To effect this proposal, three variances are requested, as follows:
- Side yard variance 1.2 m to .9 m (0.3 variance)
- Building separation setback variance from 3.0 m to 1.3 m (1.7 m variance)
- Eave separation setback variance from 3.0 m to 0.0 m (3.0 m variance)
The proposed Garage area, on the existing flat rear yard and driveways end, is included in the lot FSR. The total floor area (Main, Flex, Upper + Garage) is 284.9 m² with 45 m² garage exemption - FSR .28- OR 329.9m² without the 45m² garage exemption -FSR .32; both well within the .42 FSR maximum. Site Coverage (Main, Upper overhangs, Garage, Decks + Upper Deck) is at 24.4%, well within the 40% maximum. Existing house utilities (water, electricity) and storm drainage will be linked to the new proposed Garage.
Please appreciate that the lot area is greatly compromised for resident usage as the Restrictive Covenant ‘greatly’ constricts the lot; other R1 lots don’t experience this hardship. We are happy to be stewards of the land and have enlisted arboreal professionals to maintain our obligation. The SFD is relatively small and cottage-like and we simply would like to expand our use of the dwelling.
The Garage/Shed design is complementary to the existing house, duplicating roof slope, exterior materials & colours, feature window and melds with the Anya Court streetscape. Neighbours retain all their privacy, sunlight and views. We canvassed our abutting neighbours. They all voiced their support of the building of our detached garage and a form showing their signatures was submitted in late December. In addition, we met in person with the new owners of 209 Anya Lane on December 28, 2022 to discuss the project and the Parsons Cove Strata Council has been informed of the project. The Strata Council has expressed no concerns; a letter from the Strata Council is included in the package previously sent to you.
In addition, we paid to have an Arborist Report completed by Davey Tree and it was sent to you late last year. Following feedback from the township, the arborist has since updated it. The revised report was sent today to the Planning department for review. For landscaping, we intend to plant camellias, flowering evergreen shrubs, at the back of the garage, as per the designs we have included for your review. Camellias grow best in full to partial shade and are absolutely beautiful when in bloom and are very green and attractive for the balance of the year. We know these plants will thrive in the area we have planned as we have one growing in very similar circumstances at the front of house and we love it. Camellias are very easy to maintain and can be clipped to a manageable shape and size to that they will not hang over the garage but instead will grow upwards and across as we continue to maintain them. For our neighbours across the way, the camellias will provide a delightful backdrop to the Convenant forest area for years to come.
