INTRODUCTORY READINGS TO ZONING BYLAW NO. 900, 2014, AMENDMENT BYLAW NO. 1117

RECOMMENDATION:

THAT the report dated April 28, 2023, from the Community Planner titled “Introductory Readings to Zoning Bylaw No. 900, 2014 Amendment Bylaw No. 1117” be received.

PURPOSE:

The purpose of this report is to introduce Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1117 (Attachment 1) to amend Section 13.1.1 “Principal Uses” of the existing CD-1 Zone, Comprehensive Development. Currently, Section 13.1.1(k) of the CD-1 zone permits “Light Manufacturing Medical Clinic”; however, this is not a defined use in the Zoning Bylaw. The permitted use should technically be two separate uses and listed independently of each other in the CD-1 zone.

BACKGROUND:

At the Committee of the Whole meeting held on April 11, 2023, the Committee passed the following motions:

THAT the Committee recommend to Council that:

  1. Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1117, 2023 be prepared for readings consideration; and
  2. Waive the Public Hearing in accordance with the Local Government Act, Section 464(2), as the proposed Zoning Bylaw amendment is consistent with the Official Community Plan.

The Committee waived the requirement to hold a Public Hearing, in accordance with Section 464(2) of the Local Government Act (LGA), as the proposed amendment to the Zoning Bylaw is consistent with the Official Community Plan. Notwithstanding, staff completed the notification requirements as required by the LGA and Development Procedures Bylaw No. 730, 2009 for waiver of a Public Hearing by preparing and mailing notices to all properties within 400 m of 1495 Admirals Road, 100 Aldersmith Place, and 1511 Admirals Road. A copy of the Committee of the Whole report is attached for reference (Attachment 2).

DISCUSSION:

The proposed zoning bylaw amendment will rectify a past administrative error and avoid future uncertainty in zoning interpretation. The change will ensure there is consistency and accuracy in reviewing future development opportunities in the future.

CONCLUSION:

Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1117, 2023 has been prepared for Council’s consideration. It is recommended that the bylaw receives first, second and third reading.
