NATURE OF COMPLAINT FORM - 315 Stewart Avenue
Attachment to the Wilson letter; a formal bylaw complaint regarding unlawful occupancy and incomplete construction.
NATURE OF COMPLAINT:
315 Stewart Avenue has a building permit issued in August 2021 (permit number 2607) for a new single family dwelling.
Construction has been ongoing since that date and remains incomplete. Construction is under the owner-builder Sec. 15(1)(d), 22(1)
The dwelling includes windows (to the basement) and access doors (to the basement) that remain boarded up and not functional (back filled with what appears to be temporary fill) and open and not secured trenches.
Recently, construction has re-commenced. The dock has been detached and not safely re-attached.
Sec. 15(1)(d), 22(1) the family moved into the incomplete structure over two years ago, and that they are occupying the dwelling.
I have asked the Town for confirmation that an Occupancy Permit has been issued, but in reply was informed that an active building permit exists, leading me to conclude that NO Occupancy Permit has been granted Sec. 15(1)(d), 22(1)
This is in direct violation of the Building Bylaw and should have serious consequences, as to safety etc and if true, is a defiant and wilful act against the Town's bylaws.
My complaint is that occupation (at least for two years) has taken place without an Occupancy Permit and I also ask whether the Building Permit has been properly discharged or when that can be expected.
