Dear Sarah Jones:

Thank you for the Town of View Royal’s applications for an extension to the small-scale multi-unit housing (SSMUH) zoning bylaw requirements pursuant to section 786 of the Local Government Act (“Act”), submitted to the Province April 26, 2024.

I have considered the applications in accordance with the legislation. The extensions requested are refused. With respect to View Royal’s application for an extension for areas underserved by sidewalks, it is understood that SSMUH is likely to occur gradually, giving the Town time both to implement risk mitigation measures and to undertake the planning work identified in its application.

With respect to View Royal’s application for lands that may be subject to flood and tsunami risk, the legislation does not provide for extensions for hazardous conditions. There are other tools appropriate to such conditions. View Royal should seek their own professional/legal advice to determine what applies to their specific case.

View Royal must adopt a zoning bylaw that complies with section 481.3 of the Act in relation to the areas for which an extension was requested within 90 days of the date this letter is sent.

As with all new legislation, the Province will be monitoring the SSMUH framework closely to ensure it is working as intended.
