A BYLAW TO PROVIDE FOR ALTERNATIVE MEANS OF PUBLISHING PUBLIC NOTICES

NOW THEREFORE, the Council of the Town of View Royal, in open meeting assembled, enacts as follows:

1. CITATION

This bylaw may be cited as “Public Notification Bylaw No. 1106, 2023”.

2. DEFINITIONS

In this Bylaw:

Direct Delivery of Public Notice – means the distribution of a notice via a mail service or via hand delivery to a person or business.

Email Subscription Service – means a free subscription service to receive email notifications when public notices are published on the Town’s Website.

Public Notice – means a notice that is required to be published in accordance with the Community Charter.

Public Notice Posting Place – means the public notice board located at View Royal Town Hall.

Social Media – means websites and applications that enable users to create and share content or to participate in social networking.

Website – means the official internet website of the Town whose Uniform Resource Locator is: https://www.viewroyal.ca/

3. ALTERNATIVE MEANS OF PUBLICATION

For the purpose of section 94.2 of the Community Charter, in addition to posting notices on the public notice board located at View Royal Town Hall, the alternative means of publishing a notice are:

(a) Direct Delivery of Public Notice to persons and businesses in the area affected by the subject matter of the notice (a) Distributing electronically through the Town’s Email Subscription Service; (b) Posting to the Town’s Website; (c) Posting to the Town’s Social Media Platforms.

4. TIMING OF NOTICE

The notice given under Section 3 of this bylaw must be published at least seven (7) days before the matter for which the notice is required unless the Community Charter, Local Government Act or any other enactment provides otherwise.

5. ADDITIONAL NOTICE

The public notice requirements in this bylaw are minimum requirements and do not prevent the Town of View Royal from providing additional published notice as may be deemed appropriate by the Corporate Officer.

6. SEVERABILITY

If any part, section, sub-section, clause or sub-clause of this bylaw is, for any reason, held to be invalid by the decision of a Court of competent jurisdiction, such decision does not affect the validity of the remaining portions of this bylaw.
