BYLAW NO. 1150

A BYLAW TO AMEND THE PUBLIC NOTIFICATION BYLAW IN RELATION TO METHOD AND TIMING FOR DELIVERY OF NOTICES

The Council of the Town of View Royal, in open meeting assembled, enacts as follows:

  1. The Town of View Royal Bylaw No. 1106, cited as “Public Notification Bylaw No. 1106, 2023” is hereby amended by:

    a) deleting the “Direct Delivery of Public Notice” definition in Section 2;

    b) adding the following definition in Section 2 in alphabetical order:

    “Email Subscription Service – means a free subscription service to receive email notifications when public notices are published on the Town’s Website.”

    c) replacing Section 3 (a) that states “Direct Delivery of Public Notice to persons and businesses in the area affected by the subject matter of the notice” in its entirety with the following:

    “(a) Distributing electronically through the Town’s Email Subscription Service;”;

    d) adding the following after Section 3:

    4. TIMING OF NOTICE

    The notice given under Section 3 of this bylaw must be published at least seven (7) days before the matter for which the notice is required unless the Community Charter, Local Government Act or any other enactment provides otherwise.

    5. ADDITIONAL NOTICE

    The public notice requirements in this bylaw are minimum requirements and do not prevent the Town of View Royal from providing additional published notice as may be deemed appropriate by the Corporate Officer.

    6. SEVERABILITY

    If any part, section, sub-section, clause or sub-clause of this bylaw is, for any reason, held to be invalid by the decision of a Court of competent jurisdiction, such decision does not affect the validity of the remaining portions of this bylaw.”

  2. This Bylaw may be cited for all purposes as “Public Notification Bylaw No. 1106, 2023, Amendment Bylaw No. 1150, 2024”.
