1. CALL TO ORDER

Mayor Tobias called the meeting to order at 7:00 p.m.

The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

4. MAYOR’S REPORT

The Mayor gave an update regarding matters occurring at the Capital Regional District Environmental Services Committee and changes to provincial legislation which will impact residential development. He encouraged residents to continue to remove invasive species and garbage on their property to control any potential rodent infestations. He noted that the View Royal Fire Department had attended a call at the Victoria General Hospital on April 4; acknowledged the passing of Langford’s Assistant Fire Chief, L. Craven; and commented that some health care providers have formed a charitable society.

a) Development Variance Permit 2023/01 – 305 Anya Court

1. Report dated March 22, 2023 from the Community Planner The Community Planner gave an overview of the report to Council.

C-33-23 THAT Development Permit Application 2023/01 be approved as per the March 22, 2023 report from the Community Planner titled “Development Variance Permit 2023/01 – 305 Anya Court”;

AND THAT Development Permit Application 2023/01 include the following variances:

1. variance to Section 4.6.2 of Zoning Bylaw No. 900, 2014 to reduce the minimum required setback for an accessory building from 1.2m to 0.9m in the side yard; and

2. variance to Section 4.6.3 of Zoning Bylaw No. 900, 2014 to reduce the minimum separation between an accessory building and principal building from 3.0m to 1.3m, and the minimum separation between the eaves of the accessory and principal building from 3.0m to 0.0m. CARRIED

b) Environmental Development Permit with Variance 2022/11 – 302 Bessborough Avenue

1. Report dated March 27, 2023 from the Community Planner The Community Planner summarized the report for Council.

Council and staff discussed other agencies’ required spillage mitigation procedures, consultation, and off-site construction.

2. Comments from the Applicant The applicant, S. Horsburgh, noted that this proposal is to improve the upland portion and provide safe access to the foreshore area. She stated there is neighbourhood support, the application meets the Department of Fisheries and Oceans and Department of National Defence regulations and will be built to a high environmental standard.

Council and the applicant discussed compliance with Town of View Royal dock guidelines and confirmed that the dock size had been reduced since being introduced to the Committee of the Whole in February.

THAT Development Permit 2022/11 be approved as per the March 27, 2023 report titled “Environmental Development permit with Variance 2022/11 – 302 Bessborough Avenue”;

AND THAT Development Permit 2022/11 include the following variance:

1. variance to Section 3.8.2 of Zoning Bylaw No. 900, 2014 to reduce the minimum required setback from the Present Natural Boundary of the Sea for any structure from 15.0m to 0.0m. CARRIED

c) Accessible BC Act – Municipal Requirements

1. Report dated March 29, 2023 from the Corporate Officer The Corporate Officer noted that due to the tight timeline to prepare an accessibility plan, this report came forward this evening rather than to the May Committee of the Whole meeting. She then gave an overview of the report to Council.

Council and staff discussed membership and mandate of a proposed new committee focused solely on removing barriers to local government and their services; the potential role of the Intermunicipal Advisory Committee on Disability Issues (IACDI) in relation to a proposed new committee; potential synergies with or ability to change the IACDI mandate; funding and timeline for an accessibility plan; and the possibility of seeking reimbursement from the province for consultant funding.

The Corporate Officer clarified the City of Colwood’s motion and noted she will attend the April 20, 2023 IACDI meeting.

THAT View Royal provide an equal share of the costs (of up to $10,000) to retain a consultant to prepare an accessibility plan which member municipalities will apply to their own accessibility initiatives. CARRIED Councillors Mattson and Rogers opposed
