8.1 STAFF REPORTS

a) Environmental Development Permit No. 2015/14 – 327 Bessborough Close

  1. Report dated September 29, 2015 from the Planner

The Director of Development Services gave a brief presentation and summary of the report to Council.

L. Hamel, 327 Bessborough Close, noted that in removing the blackberry bushes from the site, they realized the retaining wall was slipping and was in need of immediate repair.

THAT Development Permit No. 2015/14 be approved as per the plans attached to the report from the Planner dated September 29, 2015;

AND THAT Development Permit No. 2015/14 include the following variances:

  • Variance to the height of a retaining wall from 1.2m to 1.5m; and
    • Variance to the setback from the natural boundary of the sea from 15m to 11m

AND THAT Development Permit No. 2015/14 include the following conditions:

  • That backfilled soil be removed from the base of grove of oak trees as described within the Arborists' Report from Talbot Mackenzie & Associates dated July 15, 2015;
    • A shoreline restoration plan be submitted, consistent with both the Environmental Report attached to this report and to the Natural Watercourse and Shoreline Areas Development Permit Area Guidelines within the Official Community Plan, to the satisfaction of the Director of Development Services;
    • A deposit for 125% of the reclamation cost estimate be provided to the Town as security against damage to the natural environment or landscaping deficiencies. CARRIED
