STORM WATER REGULATION BYLAW NO. 902, 2015
RECOMMENDATION:
THAT Council receive the report titled 'Storm Water Regulation Bylaw No. 902, 2015';
AND FURTHER THAT the Bylaw be forwarded to select parties for comment prior to receiving readings.
PURPOSE OF REPORT:
To introduce 'Storm Water Regulation Bylaw No. 902, 2015', which creates regulation of the use of the drainage system and disposition of storm water.
BACKGROUND:
Regulating storm water discharges falls under the jurisdiction of local government. The Town of View Royal Storm Sewer Bylaw, No. 239 was adopted in 1995, adapting the draft Bylaw promoted by the Capital Regional District. This historic document is relatively passive. The Bylaw provides the regulatory powers to prohibit certain types of wastes from being discharged into storm sewers and watercourses to protect the environment, public health, municipal infrastructure, watercourses and the nearshore marine environment.
The new Bylaw 902 is intended to add to the tools available to the Town of View Royal for regulation and enforcement of environmentally acceptable discharge of storm water and use of the drainage system.
INFORMATION:
Staff have completed a review of the Storm Sewer Bylaw in the context of developments that have taken place within our community and Council's concern regarding the receiving environment.
The revised Bylaw is once again based on a draft provided by the Capital Regional District. It is a format that has been used by a number of municipalities within the Capital Regional District and in other regions. It has also received legal review.
Features of the new Bylaw include:
- Drainage Control – The Town can assess the drainage off of private property and require improvements.
- Approval to connect – The Town requires a permit before properties may connect to the drainage system.
- Discharges of water – Certain discharges of water are permitted while others are prohibited and/or controlled.
- Inspection – The Town may enter property for the purpose of inspecting works subject to the Bylaw.
- Offenses – Penalties are increased from $2,000 to $10,000 and an MTI is introduced.
- Schedule of Fees – A schedule of fees is established to recoup costs associated with the application process and the inspection process.
- Schedule of Prohibited Waste – The existing schedule of prohibited waste is updated.

It is intended that this Bylaw be forwarded to those businesses participating in items 1,2, and 3 to receive comments and concerns. Inviting some feedback from the businesses involved will also create an opportunity for those businesses to assess compliance.
