Bylaw No. 928: Rezoning of 430 Six Mile Rd
A bylaw to create the CD-9D sub-zone and rezone 430 Six Mile Road for mixed commercial use.

A BYLAW TO AMEND THE TOWN OF VIEW ROYAL ZONING BYLAW WITH RESPECT TO CREATING THE CD-9D (LAKESIDE VILLAGE MIXED COMMERCIAL) ZONE AND WITH RESPECT TOTHE REZONING OF 430 SIX MILE RD
The Council of the Town of View Royal, in open meeting assembled, enacts as follows:
This Bylaw may be cited as "Zoning Bylaw, 2014, No. 900, Amendment Bylaw No. 928, 2015".
Subsection 11.9 of Bylaw No. 900 is hereby amended by adding the following Sub-Zone Table into the CD-9 zone, immediately after the "CD-9CS (Lakeside Village Low Density Suite Residential)" Sub-Zone Table:
CD-9D – Lakeside Village Mixed Commercial
Principal Uses
- Café;
- Conference Centre;
- Hotel, including food and beverage service facilities;
- Indoor recreational facilities;
- Medical Clinic;
- Mixed Commercial and Residential Use;
- Personal Service Establishment;
- Office;
- Recreational equipment sales, (excluding RV sales);
- Restaurant, Full-Service;
- Townhouse Residential;
- Apartment Residential;
- Rowhouse Residential;
- Retail;
- Shopping Centre (Community);
Building and Structures for a Hotel Facility
- Shall be sited not less than:
- 10.0 m from any sub-zone boundary line which abuts a public street;
- 4.0 m from a rear property line which does not abut a public street;
- Shall not exceed a height of 4 storeys or 18m measured from the existing grade at the outermost wall. The outermost wall does not include exterior projections such as balconies, canopies, sundecks, or other similar features.
Buildings and Structures for Retail Commercial / Residential Use
- Shall be sited not less than:
- 7.5 m from any sub-zone boundary line which abuts a public street;
- 4.0 m from any sub-zone boundary line which does not abut a public street;
- Shall not exceed a height of (2 1/2) storeys or 12m (39.0 ft.) measured from the average grade of the outermost wall. The outermost wall does not include exterior projections including balconies, canopies, sundecks, or other similar features.
Building Separation (Residential)
- Where one wall of any portion of a building used for residential use faces another wall of the same building or another building on the same site, buildings and structures shall be sited to provide a continuous unencumbered 90-degree horizontal arc projecting a minimum radius of 7.5m outwards from the centre of windows to habitable rooms.
- Schedule "B" Zoning Map referred to in Section 1.7 of Zoning Bylaw, 2014, No. 900, is amended by amending the zoning and zoning boundaries for lands legally described as follows:
- Lot A Section 6 Esquimalt District Plan VIP87819
which is currently zoned CD-9A (Lakeside Village Mixed Tourist/Retail Commercial and Residential) such that the zoning for the aforementioned properties is established as follows:
a. The lands as shown outlined and hatched on the sketch plan of attached hereto and forming part of this Bylaw as Schedule '1' are zoned CD-9D: Lakeside Village Mixed Commercial.
