On a more general note, the implementation of wireless networks across rural, suburban and urban landscapes within Canada often requires the infrastructure that operations these networks (i.e. towers) to be visible above tree tops. This is because the technology largely works on line of sight between the user of a wireless device and the antennas (typically located at the top of towers). As such, towers (such as the one proposed) are required to be a certain height above trees. Specific to this proposed facility, due to the height of the required structure, to provide personal, business and emergency service to the area, the structure will be visible from certain view corridors.
As per your comments below, it is not TELUS’ intent to dismiss the historical nature of the restrictive covenant, as they were not involved at the time it was implemented, and can only comment on the nature of the restrictive covenant itself. As noted, the area impacted by the restrictive covenant is several hundred metres to the south and could not protect view corridors to the towards the north (in the location of the proposed tower and other BCH transmission towers). As also noted in my earlier response, TELUS feels that the overall impact of the proposed tower, over 500 m from your homes, will have a minimal visual impact given the large distance between your homes and the tower and the marginal height of the proposed tower above the tree line (especially if the tower is reduced a further 15 feet in height from the height as proposed in the photo from Deborah’s home). TELUS has offered to reduce the height of the structure by 15 feet, are you and Deborah interested in this offer? The reduced height will impact the service to the surrounding areas of View Royal and Highlands but TELUS feels that this is a compromise they are willing to offer. The improved TELUS wireless service will benefit areas both within View Royal and Highlands.
The approval for the tree removal permit was received on Dec. 22, 2011 from the Town of View Royal. I am not sure where you received your information that it was not issued?
