Mayor Hill called the Public Hearing to order at 7:01 p.m.

3. PUBLIC HEARING
a) Statement of Public Hearing Procedure
Mayor Hill made a brief statement regarding the procedures for public hearings and indicated that this would be a combined public hearing for Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 816, 2011 and Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 835, 2012.
b) Statement of Publication of Public Hearing
The Planning Technician advised that the notice which advertised the Public Hearing was posted on the Notice Board at the Municipal Office on June 22, 2012. The notice was also advertised in two consecutive issues of a newspaper being the Goldstream Gazette on Wednesday June 27, 2012 and Friday June 29, 2012. A total of 1096 notices were mailed on June 22, 2012 to owners and residents of land located within a 400m radius of the subject property.

A Bylaw to Amend the Land Use Bylaw with Respect to the Zoning of 40 High Street and 287 Pallisier Avenue to the P-9 (Local Institutional) Zone
Comments from Municipal Staff The Planning Technician gave a summary of the application to Council, noting the rezoning of two properties – 40 High Street and 287 Pallisier – with P-1 zoning to a P-9 zoning.

Comments from the Public a) L. Evans, 290 View Royal Avenue, asked staff to define the differences between “assembly use” and “civil use”. b) D. Torgeson, 283 Pallisier Avenue, noted his support for the Pallisier site to be zoned as residential. He also stated that he does not support the site being used for a child care facility, community care facility, public hospital, or a school as he feels they would provide hardship to the surrounding residents. c) K. Hyrbko, 291 Stewart Avenue, stated that the church hall at the Pallisier site is a significant size and would prefer to see further restrictions on use. d) R. Hyrbko, 291 Stewart Avenue, spoke to Council questioning why the Pallisier site is not being zoned as residential. He also noted his concerns regarding parking. e) D. Frewing, 286 View Royal Avenue, spoke to Council stating that her property backs on subject property. She would like to see the Pallisier site return to single family zoning due to parking limitations. f) R. Lee, 296 View Royal Avenue, stated that he feels the P-9 uses are not appropriate including child care facility, community care facility, public hospital, and school. He is also concerned with the ability to construct up to three storeys and setbacks for buildings. g) L. Freeman, representing Strawberry Vale Community Club, 11 High Street, spoke to Council stating how the High Street site affects the community atmosphere and heritage feel. The Club is greatly concerned that the zoning will impact their property and wondered if their zoning would be changed as well. h) M. Wiltshire, 1247 Stancil Lane, spoke to Council about the Diocese’s recent activities at the High Street site. He appealed to Council to consider full heritage status for the property. i) S. Dana, 311 Stewart Avenue, noted his support for the use of the Pallisier site as a child care facility. He reminded those in attendance that on-street parking is not for the private use of the adjacent homeowners. j) M. Price Wiltshire, 1247 Stancil Lane, expressed her desire to see the High Street site preserved. k) E. Seedhouse, 56 – 1501 Glentana, spoke to Council in regards to the High Street site stained glass windows, stating that the stained glass windows were installed after the building was well in use. l) S. Carter, 8 Eaton Avenue, spoke to Council stating that the P-9 zoning is appropriate for the High Street site and some of the currently permitted uses will be excluded. She supports the use of a child care facility in the P-9 zone.
