Correspondence from F. Beckow and P. Beckow Re: Request to Remove Covenant 19 from 113 Atkins Road

Dear Mayor Hill and Council,

Thank you, Mayor Hill, for meeting with us on June 22. The meeting with you and Mr. Kim Anema was very helpful to us in seeing our situation more clearly.

Our request to Mayor and Council is to remove Covenant 19 from our Land Title agreement. The covenant restricts legal suites in our strata development.

The majority of houses in the development are on Anya Lane and were not built with suites. Our house address is not on Anya Lane. It is on Atkins Road (113 Atkins) and our situational concerns differ from the Anya Lane residents though we pay our strata fees and have friendly relations with our neighbours.

Our request is that you remove covenant 19 from our property as separate from our Anya Lane strata neighbours. We have two 'non strata' neighbours on Atkins Road that do have suites and we have never had any kind of problem.

Our property does have the requirements for a legal suite, including parking spaces, prescribed by View Royal. The address is within the boundaries for secondary suites created in 2006. As far as we are able to determine, the requirements are in place for application to legal status for our suite with the exception of covenant #19 and factors unknown to us.

We would appreciate your consideration of our request as it will allow us to stay in our lovely View Royal home.
