PURPOSE:

To consider a development variance permit application for the length of an accessory building and for the separation of an accessory building from a principal building.

The applicant’s rationale for the requests is as follows:

  1. They would like to site the new building in the same location as the old accessory building.
  2. They would like to reuse and add on to the partial foundation of the old accessory building.
  3. The building length would keep the building narrow and situated on existing hard surface. This would also minimize intrusion into the rear yard, which features a large willow tree.

CONCLUSION:

No staff concern

  • Building staff observe the partial foundation appears to have potential for reuse, subject to certification by a structural engineer.
  • The proposed building separation is minor and has no impacts on neighbouring properties.

ALTERNATIVES:

Council may:

  1. Decline the application; or
  2. Refer the application back to staff for further refinements to the requested variances.

RECOMMENDATION:

THAT Development Variance Permit 2023-07 for 25 Chancellor Avenue be approved as per the report titled “Development Variance Permit 2023-07 – 25 Chancellor Avenue” from the Senior Planner dated October 11, 2023;

AND THAT Development Variance Permit 2023-07 include the following variances:

  1. Variance to Section 4.6.2 of Zoning Bylaw No. 900, 2014 to increase the maximum length of an accessory building within from 7.5m to 9.15m; and
  2. Variance to Section 4.6.3 of Zoning Bylaw No. 900, 2014 to reduce the minimum separation of an accessory building from the principal building from 3.0m to 2.8m.
