ROAD CLOSURE AND REMOVAL OF HIGHWAY DEDICATION – ROAD ALLOWANCE NORTH OF 1352 TRANS-CANADA HIGHWAY

THAT Council give first, second and third readings to “Road Closure and Removal of Highway Dedication Bylaw No. 965, 2017”.

PURPOSE OF REPORT:
To put forward “Road Closure and Removal of Highway Dedication Bylaw No. 965, 2017” for consideration.
BACKGROUND:
In September 2016 a request came forward from the developer of 1342 and 1352 Trans-Canada Highway to purchase road allowance (approximately 677.08 square metres) north of 1352 Trans-Canada Highway (see Attachment “A”) to facilitate their proposed future development.
At the September 20, 2016 Council meeting, Council passed the following resolution:
THAT Council support in principle the request for the purchase of a road allowance north of 1352 Trans-Canada Highway by the applicants of the project proposed for 1342 and 1352 Trans-Canada Highway;
AND FURTHER THAT the support in principle for this transaction be subject to the following conditions:
- Council approval of the property disposition;
- adoption of a road closure bylaw;
- receipt of appraisal-provided market value, taking into account any added value obtained from consolidation for rezoning and/or subdivision;
- Ministry of Transportation and Infrastructure approval, if required;
- successful running of statutorily required road closure and disposition advertisements;
- consolidation of the subject property with 1342 and 1352 Trans-Canada Highway; and
- all related costs to be borne by the purchaser, including but not limited to appraisal; legal, Land Title and Survey Authority of BC, survey, staff time and advertising;
AND FURTHER THAT the Town’s authorized signatories be permitted to execute the required documentation. (C-85-16)
Currently the subject property is being appraised and information will be provided to Council when it becomes available. To ensure the application can continue to proceed smoothly and in a timely manner, it is appropriate to begin the bylaw readings process. Accordingly, this report seeks Council’s approval for first, second and third reading of Road Closure and Removal of Highway Dedication Bylaw No. 965, 2017.
RECOMMENDATION:
