RE: MUNICIPAL CONSENT FOR BYLAW NO. 4375 LIQUID WASTE MANAGEMENT CORE AREA AND WESTERN COMMUNITIES SERVICE LOAN AUTHORIZATION BYLAW NO. 2, 2020

The Capital Regional District is seeking municipal consent for Bylaw No. 4375, a bylaw to authorize the borrowing of $34.3M for the estimated cost of works relating to the Liquid Waste Management Core Area and Western Communities Service.

On August 12, 2020 the Capital Regional District (CRD) Board adopted Bylaw No. 4304 which consolidated the entire Core Area Liquid Waste infrastructure as one system and established a new funding formula for capital and operating expenses. As part of the background information leading up to the adoption of Bylaw No. 4304, municipal staff were presented with the long-range capital plan for the Core Area wastewater system.

The first 5 years of proposed projects were included in the 5-year (2021-2025) Capital Plan and approved by the CRD Board on March 24, 2021. See the attached table for the complete list of projects to be funded by the two Loan Authorization Bylaws.

As noted in the Plan these projects totaling about $57 million are all to be funded by two Loan Authorization Bylaws (No. 4374 for $22.7M and No. 4375 for $34.3M). Two Loan Authorization Bylaws were prepared because some projects were previously approved in the current Core Area Liquid Waste Management Plan (LWMP) (totaling $22.7M) and the remainder of the projects (totaling $34.3M) were not included in the LWMP. Borrowing for projects included in the Liquid Waste Management Plan under Bylaw No. 4374 do not require participant approval, therefore municipal consent is not being sought for Bylaw 4374.

In order to adopt Bylaw No. 4375, municipal consent is required from 2/3rds of participants which include the City of Colwood, Township of Esquimalt, City of Langford, District of Oak Bay, District of Saanich, City of Victoria, and Town of View Royal.

Please have your Council consider the bylaw at an upcoming meeting and return a response to us no later than May 7, 2021. Your Council resolution may be worded as follows:

That Council [consent/not consent] to the CRD adopting Bylaw No. 4375, “Liquid Waste Management Core Area and Western Communities Service Loan Authorization Bylaw No. 2, 2020”.

As background information, please find attached the proposed bylaw, staff report, and five year capital plan. A copy of the Core Area Liquid Waste Management Plan is available on the CRD website.

In addition to municipal Council consideration, the bylaw will be forwarded to the Inspector of Municipalities for approval before returning to the CRD Board for adoption.
