Development Variance Permit No. 2020/01- 8 Eaton Avenue

RECOMMENDATION:

THAT Council approve Development Variance Permit No. 2020/01 for 8 Eaton Avenue.

I concur with the recommendation.

PURPOSE OF REPORT:

To introduce an application for a Development Variance Permit to locate an accessory building at 8 Eaton Avenue.

BACKGROUND DISCUSSION:

An application to construct an accessory building at 8 Eaton Ave has been received from the property owner. A letter from the applicant is included as an attachment to this report (Attachment 1). The property is zoned R1-B. The existing house sits closer to Burnside Road. Before the current property owners purchased the property, retaining walls and a slab foundation were created. The slab is currently used to store a recreational vehicle. The accessory building is proposed to be located in the rear yard and meets the size and height requirements for an accessory structure. An excerpt from the site plan (Attachment 2) is below:

The application requires two variances to allow the accessory building to be located as proposed:

  1. Variance to Zoning Bylaw No. 900, 2014 Section 3.7.2.a from 0.6m to 0.4m in reference to the distance from any lot line into which an eave may project.
  2. Variance to Zoning Bylaw No. 900, 2014 Section 7.3.4 Minimum setback of 1.2m from all lot lines - from 1.2m to 0.7m

The property owner has notified and consulted with nearby neighbors (Attachment 5) and while there is support, the neighbor most directly impacted by the proposal does not support the variance requests (Attachments 3 & 4).

The adjacent property at 10 Eaton Ave has an unusual and longstanding configuration where the ‘front’ door to the residence is located on the side of the building, immediately adjacent to the area where the accessory building is proposed.

Staff is concerned regarding the impact of the proposed accessory building on the adjacent neighbour. While there may be additional costs for the property owner to remove retaining walls to pull the proposed accessory building back from the lot line to meet setback requirements, this may be warranted in considering the concerns expressed by the neighbour.

This application requires notification to surrounding properties to be formally considered by Council. If Council does not wish to consider the Development Variance Permit application they can decline the application by making a motion to that effect at this meeting. If Council wishes to consider the application, staff will prepare the notices and send them in advance of the next Council meeting scheduled for May 19, 2020.

RECOMMENDATION:

THAT Council approve Development Variance Permit No. 2020/01 for 8 Eaton Avenue.
