Mayor Screech called the Public Hearing to order at 7:03 p.m.

3. PUBLIC HEARING
a) Statement of Public Hearing Procedure
Mayor Screech made a brief statement regarding the procedures for public hearings and indicated that if people had questions during the public hearing, they could email him as an additional way to reach out. He then provided his email address.
The Mayor noted that the public hearing is for those who believe their interest in property is affected by the proposed bylaw to be heard or present their written submissions though everyone’s opinion is important.
b) Statement of Publication of Public Hearing
The Director of Development Services advised that the notice that advertised this Public Hearing was posted on the notice board at Town Hall on June 2, 2020. The notice was also advertised in two consecutive issues of a newspaper being the Times Colonist on Wednesday, June 10, 2020 and Thursday, June 11, 2020. A total of approximately 597 notices were mailed on June 3, 2020 to owners and residents of land located within a 400 metre radius of the subject property.

4.1 STAFF REPORTS
a) Rezoning – 3, 5 and 9 Helmcken Road and 1449 Burnside Road West (Eagles Nest)
1. Report dated June 10, 2020 from the Community Planner
The Community Planner summarized the rezoning application for the properties located at 3, 5 and 9 Helmcken Road and 1449 Burnside Road West. He highlighted the potential unit mix; density; floor space ratio; number of subzones and storeys; site data summary; woonerf concept; tenant compensation package; and conditions yet to be met. The Community Planner indicated that should the rezoning be approved, a Form and Character Development Permit application would be required to come before Council at a later date.
In response to questions from Council, it was noted that access and egress is proposed from Burnside Road West; the proposed bylaw requires Ministry of Transportation and Infrastructure approval as the site is within 800 metres of a controlled access highway; the right-of-way over 15 Helmcken Road is to the benefit of the Town and is not proposed to be used for this development; improvements will be required to and near the District of Saanich’s Helmcken/Burnside Road intersection; and there is insufficient space for a roundabout to be installed at that intersection.

- Planning process and engagement;
- Site plan and coverage, including setbacks and tree retention approach;
- Current and proposed Helmcken Road streetscape;
- Proposed height in relation to neighbouring properties;
- Transportation demand management and amenities; and
- Next steps should the project proceed through the rezoning application.
Council and the consultants discussed transit pass incentives and height being consistent with the Official Community Plan (OCP).

3. Comments from the Public
a) D. Gawley, 15 Helmcken Road, stated his concerns with the application being inconsistent with the OCP, floor space ratio, height, density, scale, and lack of diversity in housing type being built in the area.
b) S. Melanson, 15 Helmcken Road, noted that while she is not against development, she is concerned with the application in relation to the OCP, density, height, lack of variation in housing types, and loss of community ambiance. She feels that townhouses would be a better alternative for this location.
c) M. Quenet, 1481 Burnside Road West, indicated her opposition to the application due to concerns with height and traffic impact to Burnside Road West. She said that the COVID-19 pandemic makes it difficult for people to engage in the public hearing as it is being held over the telephone.
d) B. Beagle, 15 Helmcken Road, stated his opposition to the application and his concerns with density, impact of the market downturn, and the adjacent Agricultural Land Reserve (ALR) property. He expressed that an executive townhouse project would be more suitable to the community.
e) M. Strome, 1275 Burnside Road West, noted his opposition to the application and his concerns with density, setbacks, scale, and height.
f) S. Henry, 3906 Holland Avenue, indicated her opposition to the application and her concerns with density, proximity to ALR land, height, traffic and parking.
g) R. Painter, 1 Tuzo Court, stated his support for the project as there is a need for housing in the region and this project will provide amenities and affordable housing. He also noted that the applicant has held several community engagement meetings and revised the project in response to the feedback received.
h) S. Melanson, 15 Helmcken Road, spoke to Council regarding the number of speakers that are opposed to the application.
i) M. & R. Quenet, 1481 Burnside Road West, stated their concerns with the visual impact to the neighbourhood and questioned measurement of height. The Director of Development Services noted height is measured from average or finished grade, whichever is lower; and that there is a complete definition as well as an illustration in the Town’s Zoning Bylaw for reference.
j) M. Strome, 1275 Burnside Road West, noted there are several residents in the area who are opposed to the application and he stated his concerns with height, density and neighbourhood character.
k) S. Henry, 3906 Holland Avenue, noted her concerns with the impact of blasting to adjacent buildings and tree retention.
l) R. Painter, 1 Tuzo Court, stated he understands this is important to those impacted but shaping the future vision of View Royal is also important.
m) R. Smith, 21 Conard Street, noted her concerns with traffic on Helmcken Road and narrow roads.
n) J. Smith, emailed the Mayor to inquire if this project, if it is approved, will entail blasting, and if so, what will be the impact to heating systems nearby. In response the Director of Development Services stated that the Town of View Royal does not regulate blasting. Those undertaking blasting are required to carry out pre and post condition inspections of nearby properties.
