Dear Sirs,

There are 23 lots on Nursery Hill Drive managed by Strata VIS 6081 Council members. The Bylaws of the Town of View Royal require uninterrupted access of emergency vehicles at all times and no street parking is allowed. This Bylaw is applicable not only to the residential area but also includes the condos on lower Nursery Hill Drive.

Since the start of the Nursery Heights construction, residents have been very accommodating, however, in the last two months, the Strata has received numerous concerns from residents regarding the following:

  1. Trucks of construction workers parked on Nursery Hill Drive: a. Vehicles are within our Strata boundary as well as in the rest of the street, impacting the flow of traffic and often limiting vision to navigate past construction and residential traffic. b. Residents who requested the construction teams to move vehicles received disrespectful responses. c. The issue has been brought to the attention of your site manager by the Strata on several occasions but without any results.
  2. Commercial vehicles: a. Loaded gravel trucks block the road and gravel and dirt is scattered all across Nursery Hill Drive causing a safety hazard for pedestrians and residential traffic.
  3. Road safety: a. During the first week of August, a delivery truck hit a car parked on the driveway of 400 Nursery Hill Drive. b. The owner’s driveway was damaged, the RCMP were involved and a ticket was issued to the driver of the delivery truck.
  4. Relationship of contractors and residents: a. Residents experience impolite remarks from construction and on-site staff as they simply ignore any request not to block traffic or park the vehicles on Nursery Hill Drive. b. No signs are posted and traffic is not flagged by an on-site person.
  5. Construction: a. We appreciate construction workers have to be on-site by 07:00 but several noise complaints have been received with work commencing before the time as per Bylaw regulations.
  6. Status of road: a. The Developer of Strata 6081 complied with the View Royal development regulation and you will note that the residential area starting from Lots 2 and 22 has been paved (double layer). b. Construction vehicles continue to use the road despite the absence of a turnaround area. We expect an inspection at the end of construction and any damage to be repaired. c. The roadway of Nursery Hill Drive starting from Six Mile Road has deteriorated since the start of the construction with use by construction vehicles and equipment. Our understanding from the Town of View Royal is that on completion of construction, you will add the second/final asphalt layer.

As the project and construction will continue for several months before completion, your urgent attention to address the issues at hand with all construction teams and respect for the concerns and risks identified by residents are required.
