RECOMMENDATION
THAT Council give Bylaw No. 944, 2016 first and second reading;
AND THAT Council waive the requirement for a Public Hearing for Bylaw No. 944, 2016.

PURPOSE OF REPORT
To present Council with a report describing Bylaw 944, 2016 which amends the Zoning Bylaw approximately 18 months after its adoption. The amendments are housekeeping in nature and designed to make corrections and minor changes to the bylaw.
BACKGROUND
The Town adopted Zoning Bylaw No. 900 2014 in September 2014. Since then, staff have kept notes regarding the amendments which should be made, either in terms of typographical errors or, more importantly, in tweaks to the regulation based on feedback from clients and from issues which staff regularly encounter. This is not a major overhaul; rather it is an update to largely improve clarity in the bylaw, or address frequent or clear problems.
The rationale and the explanation of the significant amendments were brought forward to Committee of the Whole on March 8, 2016. That report is attached to this report. Note that a few changes have been made since, as should be self-evident when reviewing the amendments.
ISSUES AND ANALYSIS
Staff recommends that the Public Hearing be waived for Bylaw No. 944, 2016 as all amendments which would otherwise require a Public Hearing are minor, are to correct errors, or, in the case of the rezoning of lands to P-5: Transportation, consistent with the Official Community Plan.
Staff recommends that first and second reading of the bylaw be given. Advertising in two consecutive local newspapers is required before third reading, and the signature from the Ministry of Transportation and Infrastructure is also required before adoption.
Staff expects that the bylaw will come forward for adoption either June 21 or July 5, 2016, depending on whether MOTI is willing to sign a second reading or third reading copy of Bylaw No. 944.
