BYLAW NO. 1073

A BYLAW TO RECOVER THE COST OF PROVIDING EMERGENCY RESPONSE SERVICES AT THETIS LAKE REGIONAL PARK

WHEREAS the Council of the Town of View Royal wishes to enact a bylaw to deter reckless and dangerous conduct at Thetis Lake Regional Park and to recover the costs of providing Emergency Response Services associated therewith;

The Council of the Town of View Royal, in open meeting assembled, enacts as follows:

1.0 Interpretation

1.1 In this Bylaw:

(a) "Drugs" includes cannabis as defined in the Cannabis Act (Canada) and controlled substances as defined in the Controlled Drugs and Substances Act (Canada).

(b) "Emergency Response Services" means aid provided by the Town of View Royal Fire Department within Thetis Lake Regional Park involving medical assistance or rescue efforts.

(c) "Liquor" includes beer, wine, spirits or other product that is intended for human consumption and that contains more than 1% alcohol by volume.

2.0 Prohibited Conduct

2.1 No person, when in Thetis Lake Regional Park, shall:

(a) distribute, sell or consume Liquor unless the person holds a valid Special Event Permit from the Province and a valid Park Permit issued by the Town, and then only in accordance with the Special Event Permit and the Park Permit;

(b) jump or dive into any body of water from a rock or cliff at a height that exceeds one meter from the surface of the water;

(c) enter any body of water while impaired or intoxicated by Liquor or Drugs; or

(d) otherwise engage in any conduct or activity that is reckless or dangerous.

3.0 Offence

3.1 Any person who causes, permits or allows anything to be done in contravention or violation of this Bylaw, or who neglects or fails to do anything required to be done pursuant to this Bylaw, contravenes this Bylaw and commits an offence.

3.2 Each day such an offence is caused, or allowed to continue, constitutes a separate offence.

3.3 Any person guilty of an infraction of this Bylaw shall be liable to the fine(s) defined in the Municipal Ticket Information Bylaw No.643, 2007.

4.0 Fees

4.1 Any person who engages in any conduct specified in Section 2 of this Bylaw and who receives Emergency Response Services shall be required to pay a fee for the provision of Emergency Response Services to that person.

4.2 The fee shall be levied based on the equipment and personnel deployed to provide the Emergency Response Services, as set out in Schedule “A” attached to and forming part of this Bylaw.

4.3 The fee shall be calculated commencing at the time the Town of View Royal Fire Department receives the dispatch call until the time that the equipment and personnel are back in service and available to respond to a subsequent call for service, rounded to the next 15-minute increment.

4.4 Any fees imposed under Section 4.0 are due and payable within forty-five (45) days of the provision of the Emergency Response Services.

5.0 Citation

This Bylaw may be cited for all purposes as “Thetis Lake Park Emergency Response Services Cost Recovery Bylaw No. 1073, 2021”.
