Good morning

We are resubmitting our letter of September 6th, 2022 regarding the application for the REZONING APPLICATION 3360-20/2022/04- 335 STEWART AVENUE.

Attention Committee of the Whole:

We are not aware if this application has changed since our earlier opposition letter on September 6, 2022 and why it is coming to the COW again in November. We did not hear any response to the application in September.

Both Tony Dellaviola and Janice Dellaviola reside at 333 Stewart Avenue, 2 doors down from the property in question and we are directly affected by this zoning application exemption. We are opposed to the Rezoning application 2022/04-335.

Zoning bylaws were put in place for good reason, in this particular case – Bylaw #900.

Exceptions to Zoning bylaws should be for serious, consequential reasons, otherwise View Royal is setting a danger precedent in allowing exceptions. Future considerations of applications of exceptions to these bylaws will be used in every application as a ruling precedent (that property got one, so should we).

The impacts from the development to a single-family dwelling far outweigh the benefits to the local neighbourhood in this area. Some of the concerning impacts are the affects of trees, wildlife habitat and weather (winds, rain run off etc.).

Given all the good work the Town of View Royal has done around climate impact and housing shortages. This rezoning does not assist this in anyway. This additional space for the homeowner does not provide another home for people in View Royal, just additional space for a single-family dwelling owner.

The council should weigh the increase development size against the zoning bylaws and the impacts to the Climate Action plan. We should not be considering variances or rezoning applications unless there is a considerable reason.
