TOWN OF VIEW ROYAL COUNCIL REPORT

TO: Council DATE: March 13, 2014 FROM: James Davison, MCIP RPP, Planner MEETING DATE: March 18, 2014

DRAFT SOIL DEPOSIT AND REMOVAL BYLAW No. 869 THIRD READING

RECOMMENDATIONS:

THAT Council give third reading of Bylaw No. 869;

CHIEF ADMINISTRATIVE OFFICER'S COMMENTS:

I concur with the recommendations.

DIRECTOR OF DEVELOPMENT SERVICES' COMMENTS:

I concur with the recommendations.

PURPOSE OF REPORT

The purpose of this report is to produce a third reading copy of the bylaw for the approval of the Minister of Community, Sport and Cultural Development. The Ministry has reviewed the Bylaw in advance of the Minister's signature and approves of the bylaw as written, most notably the fee structure. The Ministry requires a third reading copy of the bylaw.

PROJECT INFORMATION

Council rescinded third reading of this bylaw on February 4, 2014 because the Ministry of Community, Sport and Cultural Development must approve fees charged by such a bylaw. The Bylaw was amended to include fees and sent to the Ministry for approval. The Minister's Advisory Officer contacted the Town on March 11, 2014 and indicated that the Ministry required a third reading copy of the bylaw for the Minister's signature. The Minister's Advisory Officer also advised that she saw no reason for the Minister to not sign the bylaw. Once the Minister signs the bylaw, the Town can adopt it. Target for adoption is the April 1, 2014 meeting of Council.

RECOMMENDATION

THAT Council give third reading of Bylaw No. 869;
