a. Statement of Public Hearing Procedure Mayor Hill made a brief statement regarding the procedures for public hearings.

b) Statement of Publication of Public Hearing The Planner advised that the notice which advertised this Public Hearing was posted on the Notice Board at the Municipal Office on September 4, 2014. The Notice was also advertised in two consecutive issues of a newspaper being the Goldstream Gazette on Wednesday, September 10, 2014, and Friday, September 12, 2014. A total of approximately 841 notices were mailed on September 4, 2014 to owners and residents of land located within a 400 metre radius of the subject property.

  1. BYLAW FOR CONSIDERATION

a) View Royal Official Community Plan No. 811, 2011, Amendment Bylaw No. 893, 2014 A Bylaw to Amend the Official Community Plan

1. Comments from Municipal Staff

The Planner gave a summary of the proposed amendments to the Official Community Plan Bylaw No. 811, 2011.

The Director of Development Services and Council discussed that the Official Community Plan designation for the covenanted waterfront common property at Gibraltar Bay Estates is to ensure designation consistency with other common property in stratas throughout the municipality; reflects the long-standing designation of this property prior to the adoption of the new 2011 Official Community Plan; and does not require the municipality to amend its Financial Plan with respect to an acquisition plan for parkland.

a) G. Graham, 25-118 Aldersmith Place, requested clarity in regard to comprehensive development applications; the Director of Development Services clarified the process.

b) A. Sweetnam, 210 Nia Lane, is concerned that the existing covenant does not provide enough protection to prevent future residential development on the waterfront common property at Gibraltar Bay Estates. He also expressed the desire to have seen consultation with the residents of Gibraltar Bay prior to the amendment of the bylaw being proposed.

c) R. Dodds, 201 Nia Lane, Strata President, Gibraltar Bay Estates, noted there is concern with the current zoning of the waterfront common property at Gibraltar Bay Estates; requested that this property be designated as “park”; and asked for clarification of the CD-5 zone. The Director of Development Services interpreted the CD-5 zone and noted that should the Strata wish to transfer the waterfront common property at Gibraltar Bay Estates to the Town for park purposes, the designation could be revisited.

d) B. Haines, 306 Bessborough Avenue, is opposed to the residential designation for the waterfront common property at Gibraltar Bay Estates for fear that the site will be developed. He requested that there be further protection in regard to the property and would like to see the land given to the Town to preserve the park usage.

e) F. Rudge, 407 Margaret Lane, noted that the waterfront common property at Gibraltar Bay Estates has extremely limited, sub-standard frontage onto Palmer Station which would prevent development. He also commented on the property’s rough terrain.

f) L. Northcott, 205 Nia Lane, questioned why the waterfront common property at Gibraltar Bay Estates was initially going to be zoned parks as opposed to residential. The Director of Development Services noted there was an error in the initial staff report which was remedied for the public hearing notice and the proposed residential designation reflects the long-standing pre-2011 designation.
