1. CALL TO ORDER

Acting Mayor Lemon called the meeting to order at 7:00 p.m.

The Acting Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

8.1 STAFF REPORTS

a) Development Variance Permit Application No. 2021/04 – 2679 Myra Place

1. Report dated February 23, 2022 from the Senior Planner

The Senior Planner gave an overview of the application that would facilitate an approximately 200m2 boundary adjustment between 2679 Myra Place and 2675 Myra Place if approved.

Council discussed the current unsanctioned public use of both the private strata road and the applicant’s private strata property to access the Galloping Goose Regional Trail. The Chief Administrative Officer noted that the access is trespassing as there is no statutory right-of-way authorizing public access over the strata road or the applicant’s individual strata property. He stated that any such use should be regularized through the Capital Regional District as the Galloping Goose is a regional trail.

2. Comments from the Applicant

a) F. Harding discussed the historic access to the Galloping Goose over his property; the volume of current public usage; the request by his insurer to post it as private property; safety issues on Atkins Road; and that he is not adverse to having the public traverse his property for the time being, but is concerned about liability.

3. Comment from the Public

a) Don Brown, 199 Atkins Road, expressed his support for the application and appreciation to the property owners for allowing their private property to be traversed by neighbours to access the Galloping Goose Regional Trail. He stated his concerns regarding pedestrian safety on Atkins Road due to its width. He noted installation of a sidewalk on Atkins Road would remove the need to traverse the private strata property on Myra Place to access the Galloping Goose Regional Trail.

C-20-22 THAT, pursuant to Section 58 (1) of the Local Government Act, that Kenneth Lyle Schaalje be appointed Chief Election Officer for conducting the 2022 general local elections;

AND THAT Marion Bernice Villines and Elena Bertina Bolster be appointed Deputy Chief Election Officers for the 2022 general local elections. CARRIED

Councillor Kowalewich shared highlights of the meeting including after school care program, bus route changes, staff shortages, and the approval of the 2022 budget.
