1. CALL TO ORDER
Mayor Screech called the meeting to order at 7:00 p.m.
The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation and that today is National Indigenous Peoples’ Day.

C-68-22 THAT Development Variance Permit No. 2022/02 for 280 Island Highway be approved as per the July 13, 2022 report from the Senior Planner; AND THAT Development Variance Permit No. 2022/02 include the following variances to requirements of Zoning Bylaw No. 900, 2014:
- variance to the required number Class 1 (secure and covered) bicycle parking spaces within Section 5.5.1 of the bylaw from 37 to 24; and
- variance to the required width of maneuvering aisles in an underground parking area within Section 5.7 of the bylaw from 6.7m to 5.5m. CARRIED

THAT Development Permit 2021/18 be approved as per the July 14, 2022 report form the Senior Planner titled “Development Permit 2021/18 - 2000 West Park Lane (West Park One)”;
AND THAT Development Permit 2021/18 include the following variances: Development Permit 2021/08 to requirements of Zoning Bylaw No. 900, 2014:
- Variance to the maximum the height of a retaining wall from 1.2m to 2m (Section 4.8.9)
- Variance to the retaining wall vertical height to horizontal spacing from 1:1 to 1:0.75 (Section 4.8.10)
- Variance to the front lot line setback from 6m to 5.5m (Section 13.23.1)
- Variance to the rear lot line setback from 6m to 5.4m (Section 13.23.1)
- Variance to the south side lot line setback from 4.5m to 4.1m (Section 13.23.1);
AND FURTHER THAT Development Permit 2021/18 include the following conditions:
- Roof top mechanical units are to be visually screened.
- Site and building exterior lighting are to be dark skies friendly.
- A security deposit for hard and soft on-site landscaping is required prior to building permit issuance.
- Environmental impacts and mitigation measures including steep slope and interface fire hazard management be implemented in accordance with Development Permits 2019/02 and 2020/10.
- The security deposit of $50,000 provided in Development Permit No 2019/02 to address any unsafe conditions or damage to the natural environment will apply to the works authorized in this development permit. CARRIED

e) Short Term Regulation Amendment Bylaw No. 1105 – Short Term Rentals
- Report dated July 13, 2022 from the Community Planner The Community Planner gave a summary of the report to Council. Council and staff discussed secondary suites not being used for short term rentals and municipalities that are taking a similar approach to short term rentals.

C-73-22 THAT the Town write to the Premier of British Columbia and the Minister of Public Safety and Solicitor General, M. Farnworth, to express support for the West Shore RCMP and the sub-regional policing model at that detachment and to request that no changes be mandated to this policing model without prior engagement involving the local government participants. CARRIED

C-74-22 THAT staff move forward with the Pedestrian Street Lighting Improvement project for both roundabouts on Helmcken Road and defer the improvements at Chilco Road/Lund Road intersection to 2023;
AND THAT the 2022 Pedestrian Street Lighting Improvement project be award to Victoria Contacting and Municipal Maintenance Corporation (VCMMC) in the amount of $99,575 plus GST. CARRIED
