MINUTES OF A COUNCIL MEETING HELD ON TUESDAY, MAY 2, 2023

1. CALL TO ORDER

Mayor Tobias called the meeting to order at 7:00 p.m.

The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

2. APPROVAL OF AGENDA

4. MAYOR’S REPORT

The Mayor thanked Councillor MacKenzie and staff for organizing the Best in Bloom contest which commences on May 5; and noted that the “Our Women are Sacred” march is being held on May 5 and sponsored by the Songhees Nation. The Mayor will be participating in an event marking the coronation of King Charles III; and the Juan de Fuca Recreation Centre’s skateboard park will be opening on May 13.

The Mayor noted he donated his remuneration increase back to the Town.

Spoke to Council regarding the development at 7 Erskine Lane, specifically, whether it will result in a second access point for Erskine Lane.

7. BUSINESS ARISING FROM PREVIOUS MINUTES

a) Rapid Transit Mobility Hub – Councillor Rogers

Councillor Rogers noted his concerns regarding the proposed rapid transit mobility hub, specifically, the traffic light, realignment of Galloping Goose Regional Trail, and the park and ride.

Council discussed ownership of land in the rapid transit mobility hub area and use of land for a park and ride.

C-65-23 THAT BC Transit be asked to provide the latest conceptual drawings of the Atkins Road mobility hub from Island Highway to Atkins Road;

AND THAT staff obtain a copy of the Ministry of Transportation and Infrastructure’s presentation regarding the Bus on Shoulder Project from the April 2023 Committee of the Whole meeting, and traffic analysis for this Project and surrounding roads;

AND FURTHER THAT BC Transit be asked to commit to proactive public consultation and keeping the Town apprised of significant project developments, including signalization plans. CARRIED

a) Development Permit 2023-02 – 7 Erskine Lane

1. Report dated April 26, 2023 from the Senior Planner The Senior Planner gave a summary of the report to Council. Council and staff discussed form and character.

2. Comments from the Applicant K. Klippenstein, VDA Architecture Ltd., discussed onsite resident amenities and the completion of the soil remediation. Council and Mr. Klippenstein discussed timeline for construction, protection of green space and mitigation of highway traffic noise.

C-66-23 THAT Council authorize the issuance of Development Permit No. 2023-02;

AND THAT Development Permit No. 2023-02 include variances to the provisions of Zoning Bylaw No. 900, 2014 for the following:

• maximum building height of a building from 13.5m to 17.0m;
• minimum front lot line setback from 7.5m to 6.8m;
• minimum rear lot line setback from 7.0m to 6.5m;
• maximum projection of a balcony into a required setback from 0.5 m to 1.2m;
• maximum width of a balcony projection into a required setback from 2.0m to 4.5m;
• maximum width of sunlight control projections per building face from 4.0m to 11.0m; and
• maximum height of a retaining wall from 1.2m to 3.4m;

AND THAT Development Permit No. 2023-02 include the following variances to the provisions of Subdivision and Development Servicing Bylaw No. 985, 2017 to facilitate potential modifications to the road frontage of this property:

• variance to requirements for pocket parking to permit a parking island within a cul-de-sac bulb; and
• variance to the frontage requirements to permit the construction of a separated bicycle lane;

AND THAT Development Permit No. 2023-02 include the following conditions:

• visitor parking spaces should be identified in the building permit plans; and
• a security deposit for hard and soft landscaping is required prior to building permit issuance;

AND FURTHER THAT staff work with the applicant to incorporate sound mitigation measures. CARRIED Mayor Tobias opposed

b) Six Mile Road Improvements – BC Hydro Payment

1. Report dated April 25, 2023 from the Director of Engineering and Parks The Director of Engineering gave a summary of the report to Council. Council and staff discussed that the Plan is high level, will come back to Council for individual project approvals, and can be changed over time.

1. Report dated April 19, 2023 from the Corporate Officer The Corporate Officer gave review of the report to Council. Council and staff discussed safety and the involvement of the RCMP and ICBC. Council provided additional mural theme ideas. The Mayor noted improvements that are going to be made to the E&N Rail Trail.
