1. CALL TO ORDER

Mayor Tobias called the meeting to order at 8:36 p.m.

THAT the minutes of the Council meeting held November 21, 2023 be adopted as presented. CARRIED

4. MAYOR’S REPORT

The Mayor noted that the “Last Public Hearing” held at the Victoria Scottish Community Centre on November 23 was well attended and a staff report will be coming forward to a future Council meeting.

a) Appointment of Committee of the Whole

Mayor Tobias announced the Mayor’s appointments to the Standing Committees of Council, as outlined in Schedule A, a copy of which is attached hereto and forms a part of these minutes.

b) Appointment of Representatives to other Committees, Commissions and Boards

THAT the appointment of representatives to other Committees, Commissions and Boards as outlined in Schedule B, items 1 through 28, a copy of which is attached hereto and forms a part of these minutes, be endorsed. CARRIED Councillor MacKenzie opposed

THAT the Tag Days for 2024, as outlined in Schedule D, a copy of which is attached hereto and forms a part of these minutes, be endorsed. CARRIED Councillor MacKenzie opposed

e) Appointment of Liaisons and Alternate to Advisory Committees

Mayor Tobias announced the selection for Liaisons and Alternates to the Community Development Advisory Committee and Parks, Recreation and Environment Advisory Committee as outlined in Schedule E – items 1 and 2, a copy of which is attached hereto and forms part of these minutes.

5. PETITIONS & DELEGATIONS

a) L. Rojas and M. Broadbent, Re: Ban Rodent Glue Board Traps

Ms. Rojas and Mr. Broadbent spoke to Council regarding the negative impacts of glue board traps and requested that Council consider banning their sale and use in View Royal.

Council and staff discussed the possibility of banning and/or enforcement of pesticides and glue board traps, and support of a Provincial petition. Councillor Rogers will bring an Association of Vancouver Island Coastal Communities motion forward to a future Council meeting in support of a ban.

a) Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1128, 2023

A Bylaw to Amend the Zoning Bylaw with Respect to Rezoning of 39, 341 and 345 Island Highway

THAT Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1128, 2023 be given third reading. CARRIED Mayor Tobias and Councillor Mattson opposed

7. BUSINESS ARISING FROM PREVIOUS MINUTES

a) Regional Free and Revised Discounted Transit Passes for Ages 13-18 – Councillor Rogers

Councillor MacKenzie stated her concern with establishing a new region-wide levy.

C-155-23 THAT the Town request BC Transit broaden the eligibility for the free youth transit pass program from ages 12 to age 13; reduce transit fares by 50% for youth ages 14 and 15, and provide fare discounts to youth ages 16-18;

AND THAT the Town write to the Capital Regional District (CRD) requesting that they establish a region-wide levy to assist BC Transit in providing free and improved discounted fares as well as relevant administration costs, and if necessary, that the program be jointly administered by the CRD and BC Transit;

AND FURTHER THAT copies of this letter be sent to all municipalities in the CRD, CRD Transportation Committee, First Nations, and School Districts 61, 62 and 63. CARRIED Councillor MacKenzie opposed

a) 247 Glenairlie Drive – Property Maintenance Violation

1. Report dated November 15, 2023 from the Bylaw Enforcement Officer

The Bylaw Enforcement Officer provided an overview of the report, outreach efforts, safety, prior boulevard work, and required next steps.

C-156-23 THAT Town of View Royal (“Town”) staff be authorized to engage a contractor, at the expense of the owners of 247 Glenairlie Drive (the “Property”), to remediate the unsightliness of the Property and to the requirements within the Property Maintenance Bylaw No. 512, 2003 (“Property Maintenance Bylaw”);

AND THAT, should the owners of the Property not pay costs incurred by the Town for remediation of the Property on or before December 31 in the year that the work is done, that the costs be added to and form part of the taxes payable on the property as taxes in arrears pursuant to section 5.6.2 and 5.6.3 of Property Maintenance Bylaw and sections 17 and 258 of the Community Charter, SBC 2003, c. 26 (the “Community Charter”). CARRIED

b) Yard and Garden Waste Contract

C-157-23 THAT the Township of Esquimalt’s award for the operation of the transfer station and processing of the yard and garden waste stream to Ellice Recycling be endorsed for a three-year period at a total contract cost of $1,019,556 (excluding GST), as detailed in the Township of Esquimalt’s staff report EPW-23-019;

AND THAT the Town contribute $129,360, $135,835.20 and $142,627.20 to the contract for the years 2024, 2025 and 2026 respectively as part of the cost sharing agreement as detailed in the Township of Esquimalt’s staff report EPW-23-019. CARRIED

c) Coastal Adaptation Plan Phase 1 (Mapping)

1. Report dated November 29, 2023 from the Senior Planner

Council and staff discussed the project’s purpose and grant funding as well as Phase 2 which will provide related guidelines based on the mapping generated through Phase 1.

C-158-23 THAT the draft Terms of Reference for Non-Core Project N-089 “Coastal Adaptation Plan Phase 1 (Mapping)” be adopted;

AND THAT Notice of Intent to Award Non-Core Project N-089 “Coastal Adaptation Plan Phase 1 (Mapping)” be made naming Associated Engineering as the lead consultant in accordance with Purchasing Policy 1600-021 sections 10.8.1 and 10.8.14. CARRIED

d) Council and Committee of the Whole 2024 Meeting Schedule
