Staff Recommendation: THAT the report dated October 11, 2017 from the Manager of Accounting titled "3rd Quarter Budget Variance and Capital Project Update Report" be received for information.
8.2 COMMITTEE OF THE WHOLE RESOLUTIONS
a) From the October 10, 2017 Committee of the Whole meeting:
Bylaw Enforcement Policy: THAT the Committee recommend to Council that the amendments to Bylaw Enforcement Policy No. 0100-033 regarding the receipt of complaints and the investigation of staff-observed issues as noted in the staff report dated October 3, 2017 titled "Bylaw Enforcement Policy" be approved. (COW-19-17)
Cannabis Legalization and Regulation in BC: THAT the Committee recommend to Council that the Town provide the following feedback to the Ministry of Public Safety and Solicitor General in regard to their discussion paper entitled "Cannabis Legalization and Regulation in BC":
- Minimum Age: minimum age of 19 years old to buy, grow and publicly possess up to 30 grams of non-medical cannabis;
- Personal Possession - Adults: limited to not more than 30 grams of dried cannabis;
- Personal Possession - Youths: limited to no more than 5 grams of dried cannabis and product may be confiscated and a ticket issued;
- Public Consumption: to follow the same requirements as alcohol and the Capital Regional District's Clean Air Bylaw;
- Drug-impaired Driving: much work and training remains to be done on this issue to ensure our communities are kept safe; this work must involve police departments and communities;
- Personal Cultivation: limited to not more than four plants per household though there are concerns regarding impacts to structures, impacts to landlords, and scent in multi-family structures;
- Distribution Model: a government distribution model should be established for the warehousing and distribution of cannabis;
- Retail: a public retail system should be established and advertising should be prohibited;
- Regulations should be the same across the Province though local governments should be able to individually determine if they wish to zone or not zone for cannabis-related uses; and
- Local governments should be included in the related revenue that will be generated. (COW-20-17)
Single Use Plastic Bag Ban - Draft Model Bylaw: THAT the Committee recommend to Council that the Town work toward the adoption of a bylaw for the elimination of single use plastic bags;
AND THAT this matter be forwarded to the Community Development Advisory Committee and the Parks, Recreation and Environment Advisory Committee for consideration;
AND FURTHER THAT the Town solicit feedback from the business community. (COW-21-17)
Town-initiated Amendment to C-8 Zone: THAT the Committee recommend to Council that staff be instructed to bring an amendment bylaw forward for consideration at the October 17, 2017 Council meeting to amend the FSR within the C-8 Zone from 0.4 to 0.42 FSR (impacting 494/498 Island Highway and 199 Island Highway);
AND THAT the requirement for a Public Hearing be waived. (COW-22-17)
