4. MAYOR’S REPORT
The Mayor wished to thank all the Fire Departments within the Capital Region who are fighting the wildfires in the interior of BC.
5. PETITIONS & DELEGATIONS
a) I. Bruce, Peninsula Streams Society (PSS), Re: Millstream Fishway (Atkins Road Culvert) Project
Mr. Bruce spoke to Council in regard to the Millstream Fishway (Atkins Road Culvert) Project, which would allow salmon to travel further up the Millstream Creek; and discussed project expense budget, fundraising efforts, grant application, and construction of the project.
Council and Mr. Bruce discussed funding and funding sources that are available for the project; and encouraged Mr. Bruce to submit a grant-in-aid application in 2018. Staff noted their concern in regard to the placement of concrete at the bottom of the culvert and requested that prior to construction there be involvement from a professional engineer and reports be provided to the Town.
b) E. Duggan, 2428 Lund Road, Re: Traffic on Lund Road
Mr. Duggan spoke to Council in regard to traffic calming measures in the 2400 block of Lund Road, specifically:
- views of the road;
- history to date of traffic calming measures;
- traffic problem;
- reason for installation of traffic calming along the 2400 block of Lund Road;
- future traffic projections;
- existing neighbourhood traffic calming; and
- traffic calming suggestions – speed limit signs, speed hump, traffic island, stop sign, and centre line.

C-82-17 THAT staff work with residents of the 2400 block of Lund Road and the developer of Chilco Road - Phases 6 and 7 (Limona Construction) for traffic calming solutions and report back to Council. CARRIED

Report dated July 12, 2017 from the Senior Planner The Senior Planner gave a summary of the report to Council. Council and staff discussed the need for certified weed-free top soil.

C-83-17 THAT Development Permit No. 2017/02 be approved;
AND THAT Development Permit No. 2017/02 include the following conditions regarding environmental protection (as per the Environmental Assessment report from Swell Environmental Consulting dated May 26, 2017 and attached to the report) are as follows:
- Removing invasive species and planting a minimum of 10m² of native vegetation to BC Landscape Standards within the development permit area, in the areas closest to the shoreline, to help develop overhanging vegetation and habitat along the shore as per the report. This includes the used of certified weed-free top soil, up to 30 cm, depending on native soil conditions after invasive species are cleared;
- timing all works including excavations, and topsoil additions within the dry season and specifically with forecasted dry weather;
- on steep slopes (>1.1:1) installing biodegradable coco-fibre mats over bare soils prior to planting;
- mulching or otherwise covering bare soils immediately;
- ensuring petroleum releases to the marine environment are avoided by:
- checking machinery for oil and gas leaks;
- providing spill containment for any generators or pumps (purpose-built trays or plastic bins);
- providing Spill Kits on-site for any machinery at work within 30m of the High Water Mark and ensuring operators are trained in their use;
- clearly marking the existing indigenous plants and their surroundings with flagging tape and/or a protective barrier that will still allow access to individual plantings;
- providing clear instructions to landscaping crews, including drawings of plants to remain and Best Management Practices outlined in the report;
- installing erosion and sediment control measures for the house construction (e.g. sediment fencing) to prevent sediment laden run-off from entering the development permit area or marine environment;
- engaging an Environmental Monitor to oversee construction activities, including (but not limited to) start up, extreme rain events, and periodically throughout the construction period to ensure Best Management Practices area follows; and
- monitoring plant survival for a two year period and replacing dead plants.
AND THAT a landscape security deposit be submitted prior to building permit issuance for the provision and installation of on-site planting and for the mitigation of potential damage to the natural environment;
AND FURTHER THAT Development Permit No. 2017/02 include the following variances:
a. variance to the maximum length or width of an accessory building from 7.5m to 15.9m; b. variance to permit the siting of an accessory building within the front yard; c. variance to the maximum lot coverage of an accessory building from 60m² to 123m²; and d. variance to the total building floor area from 372m² to 438m². CARRIED
b) Request to Remove Covenant EK061366 on Meadow Vale Drive/Riverside Drive
Report dated June 29, 2017 from the Senior Planner The Senior Planner summarized the report for Council. Council suggested that the residents of Meadow Vale Drive and Riverside Drive work with the Esquimalt Anglers Association in regard to the stewardship of Craigflower Creek.
