Regarding the letter for refusal permit for one tree to be removed from the property home. I live at 2332 Chilco Road and the tree if fell down would affect our whole property the way it is situated and would probably miss his home. Our bedrooms are located directly in line and with the height of it would destroy our fences trees and landscaping trees we have purchased over the last eight years. The letter of refusal was issued June 27 2017 and Jason showed it to me with great disappointment. I would have accepted View Royal decision but within the last week greatly changed my mind. I have owned a 10,0000 square foot lot in a 70 lot Strata at Shuswap Lake. We have never had a tree fall within the property since 1977 and now with climatic conditions wind and voids due to lack of rain every lot on the property has had within the last year an arborist come from Salmon Arm B.C and most lots had any trees removed that were considered dangerous. Well, last Friday I get a call and all the lots had so many trees uprooted within the property, deemed appearing to be healthy. My lot lines the roadway and sloops upwards and the trees fell upwards over the bank to the roadway. The cost to all lots is unreal to repair and remove the fallen trees after, houses sheds etc.. That just proved that trees that look healthy at the top now have extreme conditions to the roots and are really unsafe at anytime. The normal weather is not normal and trees need rain .

My husband was away July 10 and I was alone so being nervous I sat on my balcony facing the tree and it did not seem that windy but the tree was actually swaying and never did before. I move to the other bedroom at times if windy. We never used to get the winds 8 years ago like we do now and the tree swings in our direction. Jason has said he notices all the time it sways at the trunk.

Because of the above I am totally afraid of the tree and phoned on Tuesday to talk to Mr. Podmoroff who is on holidays about this and learned the only person that can help is the Mayor and council. I am leaving on August 15 and Jason has a fencer that may come at any time but if you can reconsider the decision will get the tree down immediately as fencers are hard to get. It is costly and for our piece of mind will help pay a portion. I did not mean to skip the step of talking to the person at 250-708-2257 and be disrespectful but wanted to be heard as soon as possible. Jason has stated he has some ideas about the removal.

Summarizing:

It is the home owner at 2328 Chilco Insurance that will have to cover any costs related to danger and damages to our place. Have you watched the news lately? The yard at the moment is undeveloped so what happens when he wants in his plans to extend the deck and starts digging at the roots or plant anything. Landscaping around it seems ridiculous because of where it is situated. The tree stands above most trees like a hydro pole with branches on top because all the dead branches have been removed. It is not bushy which seems to appear that at one point in time the tree was in stress. They have two small children that are supposed to play out there on a deck right beside it with no other trees on the property.

The tree is a protected species along with others on a list as seen on your website but Limona Homes was allowed to come into the area and completely destroy just about every kind of tree on the list especially the Arbutus and not ONE TREE is left on any lots healthy or not. We moved here 8 years ago and there was a forest on the newly changed street on Lund. How did this happen with your bylaws so strict?

The letter sent to Jason Stewart has the incorrect Tree Removal Permit Application address which makes me believe this is a form letter which makes me think maybe each case to the homeowner should be considered on its own merits and taken into consideration as is quite serious to us being affected. Also, the property which runs to the back of us had a huge healthy looking tree fall uprooted on his driveway this spring. The tree we are asking permission to cut down will present such problems in the future because of the height if the property behind is sold and developed. I also had a friend over a year ago walking around Chilco, a tree uprooted in front of her, looked perfectly healthy and the roots come out of the ground so high as it fell downhill blocked the total road.

For all the above reasons will View Royal please re-consider the decision for one tree. I appreciate that you called me back stating you would come and see the tree personally. I have talked to Jason as he knows we are scared of the circumstances and he feels the same way. Please contact Jason as soon as possible and he will meet with you. If we are home will also meet with you.
