Enabling bylaw to authorize the Town to enter into a formal Housing Agreement for the Christie Point redevelopment.

BYLAW NO. 977
A BYLAW TO ENTER INTO A HOUSING AGREEMENT UNDER SECTION 483 OF THE LOCAL GOVERNMENT ACT
The Council of the Town of View Royal, in open meeting assembled, enacts as follows:
This Bylaw may be cited as "Christie Point Housing Agreement Authorization Bylaw No. 977, 2017”.
If a portion of this bylaw is held invalid by a Court of competent jurisdiction, then the invalid portion must be severed and the remainder of this bylaw is deemed to have been adopted without the severed section, subsection, paragraph, subparagraph, clause or phrase.
The Town of View Royal is authorized to enter into a housing agreement under section 483 of the Local Government Act , substantially in the form attached to this bylaw as Schedule A, with CHRISTIE POINT APARTMENTS LIMITED, INC.NO. BC0678492 or its nominee, in respect of the lands located at 2951 Craigowan Rd and legally described as:
PART OF SECTION 2, ESQUIMALT DISTRICT, LYING TO THE NORTH OF PLAN 40 RW TO THE EAST OF THE RIGHT OF WAY OF THE ESQUIMALT AND NANAIMO RAILWAY COMPANY AND TO THE WEST OF PLAN 10960, EXCEPT PARTS IN PLANS 11627, 11919 AND 41826
The Mayor and the Corporate Officer of the Town are authorized to execute the Housing Agreement and the Corporate Officer is authorized to sign and file in the Land Title Office a notice of the Housing Agreement, as required by the Local Government Act.
