1. CALL TO ORDER
Mayor Screech called the meeting to order at 7:00 p.m.
The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

4. MAYOR’S REPORT
The Mayor extended condolences to the City of Colwood on the passing of Fire Chief John Cassidy. He also expressed sympathy to the community of Lytton for their losses during the recent wildfire.
The Mayor noted that Elements Casino reopened to the public on July 1, 2021 and, with Step 4 of the Provincial Restart Plan set to happen on September 7, 2021, the Town should be in a position to welcome the public back to Council Chambers at that time.
The Mayor noted the importance of Council to act as a whole and for the business of Council, including direction to staff, to be conducted in public rather than through email. He will be working with staff to develop a policy to address this issue.

6. PUBLIC PARTICIPATION PERIOD
a) J. Maxwell, Victoria Highland Games Association, spoke to Council regarding the status of the Craigflower Community Centre construction project at 1801 Admirals Road. He addressed his letter (item 9.1(a)), specifically requesting to have the development cost charges of $60,147.81 waived or reduced. Mr. Maxwell noted funding for the construction of the building has been required for an attenuation tank which the Association had not originally anticipated.
b) P. Hyslop, 325 Stewart Avenue, spoke to Council regarding the Environmental Development Permit for 335 Stewart Avenue.

The Community Planner gave a summary of the report to Council.
Council, staff, and consultants, L. Lessingham and L. Malmkvist, discussed the proposed retaining wall and stability to the neighbouring property; removal of creosote logs and replacement with a stacked boulder wall; sightlines; shoreline condition and scouring; and potential slope failure.

- A variance to Section 4.8.9 of Zoning Bylaw No. 900, 2014 for the height of a retaining wall in a residential zone from 1.2m to 1.8m.

The Community Planner gave an overview of the report to Council.
Councillor Rogers noted that he consulted with a lawyer who has advised him that his participation in the discussion is not a conflict of interest.
Council and staff discussed size of the proposed structure; boathouse lighting; heating source; application background; mesh blinds that can be mounted on the outside of the glass to prevent bird strikes; and terms of the Department of National Defence license of occupation.

L. Critchley, applicant, discussed the owner’s application made to the Department of National Defence and Department of Fisheries and Oceans prior to applying to the Town; building size; screening to prevent bird strikes; and boathouse lighting.

9.1 FOR ACTION
a) Letter dated July 2, 2021 from J. Maxwell, President, Victoria Highland Games Association, Re: Development Cost Charges – Craigflower Community Centre
Council and staff discussed the blanket approach to development cost charges; development cost charge categories, the purpose of development cost charges; what comprises these specifically required development cost charges; the Centre as a community resource that the Town will be able use; the inability to waive development cost charges due to Provincial legislation; the provision of a grant-in-aid as an alternative approach; the desire to see additional supporting information from the Association; and the concern for a full grant-in-aid due to budgetary pressure.

The Director of Engineering noted that the Ministry of Transportation and Infrastructure anticipates signalizing the Admirals Road/Glentana Road intersection this fall as part of the Songhees Nation development in that area.
