Re: Development Variance Permit Phase 6 Thetis Vale – Parking space length

Our request for a parking space length variance was deferred pending the provision of further information. The variance is for lots 3,4,10,11,12,13,14,15,17,18 in our Phase 6 subdivision on Lund Road as shown on the attached plan.

Our initial confusion stems from the past practice where parking spaces were permitted to extend to the back of the curb or sidewalk. I have included a site plan for lot 61 in our phase 5 on Chilco Rd. that illustrates the past practice. I have also included a photo of lot 61 as built that illustrates the result as well as a photo of the property directly across the street that shows the driveway to the back of the sidewalk. It is our understanding that this practice has not resulted in complaints to the Town.

When we developed our site plan and grading plan for both our phase 6 and 7 subdivisions we followed the past practice and the zoning by-law setback requirement of 4.5m. To change the grading plan at this point would result in further blasting where rock cuts are in the rear yards or high walls and more fill where rear yards are on the downhill side of the roadway. At this point these changes would require a redesign of the subdivision.

As expressed in our application, a 5.5m parking space does fit, in all instances, from the face of the garage to the curb or inside of the sidewalk on the lots listed. I have included a site plan for lots 3 and 15 that illustrates the distances from the curb and back of sidewalk, similar to what has been developed in Phase 5.
