RECOMMENDATION:

THAT Council deny the application for Sewer User Fee Adjustment for Water Leaks for 561 View Royal Avenue.

CHIEF ADMINISTRATIVE OFFICER'S COMMENTS:

I concur with the recommendation.

BACKGROUND:

On April 22, 2016 the Town received a request from 561 View Royal Avenue regarding an application for a sewer user fee adjustment.

As per Policy 200.33, to be eligible for consideration of a sewer adjustment the following conditions must be met: 1.1 Evidence that usage exceeds the 3 year average; and 1.2 Evidence that the leak was repaired within 30 days of the water billing or from the date the leak was discovered, whichever comes first; and 1.2.1 Evidence shall be in the form of detailed receipts, or, a copy of CRD Water Services water bill showing a leak adjustment for the consumption period. 1.3 The property owner completes the form entitled Town of View Royal Sewer User Fee Adjustment for Water Leaks Application Form.

The owner has filled out the form required, however, upon examination they do not meet requirement 1.2 above. The owner has not provided evidence, as per 1.2.1 above, that the leak in January 2015 was repaired. The applicant outlines that they did the repair themselves with parts and products that they had on hand. Receipts provided to staff with the application are for a separate, unrelated, repair that was completed in January 2014.

As the application doesn't meet the requirements of the Policy the application was denied and the applicant has written to Council to appeal staffs conclusion. Upon initial calculation the adjustment to the account should Council approve it would be $70.76.
