Council 2/16/2021 C-18-21 THAT due to the potential increase in pedestrian and vehicle traffic from the Shoreline School expansion, staff ask ICBC to undertake a safety audit at the intersection of Shoreline Drive and Island Highway; AND THAT a traffic study be completed for the intersection of Shoreline Drive and Island Highway. Council 11/2/2021 C-115-21 THAT Development Permit No. 2021/10 be approved as per the October 29, 2021 report from the Senior Planner titled “Development Permit 2021/10 – 298 Island Highway” subject to Environmental Management Act requirements;

AND THAT Development Permit No. 2021/10 include variances to provisions of Zoning Bylaw No. 900, 2014 for the following:
1. variance to the percentage of total parking spaces to be small car spaces in Section 5.5.3 from 30% to 60%; and
2. variance to the number of commercial loading spaces in Section 5.10, Table 3 from two to one.

AND FURTHER THAT Development Permit No. 2021/10 include the following conditions:
1. a covenant is to be registered prior to building permit issuance to secure the following:
a. commercial parking spaces to be available for shared use by visitors during non-business hours
b. proposed communal rooftop deck not to be used between the hours of 10:00 pm and 7:00 am to avoid any excess noise;
2. proposed encroachments are to be addressed prior to building permit issuance, at the applicant’s cost;

Council 4/19/2022 C-34-22 THAT Development Permit Application No. 2021/03 be approved as per the April 13, 2022 report from the Senior Planner titled “Development Permit Application No. 2021/03 – 221 Atkins Road”; AND THAT Development Permit Application No. 2021/03 include the following:
1. Development of the site is to be conducted in accordance with conditions stated in the Riparian Area Protection Regulation Assessment Report prepared by Tim Adam, Stantec Consulting, dated January 28, 2022.
2. Registration of a covenant to protect the Streamside Protection and Enhancement Area prior to approval of the subdivision.
3. Areas where storm water is to be conveyed downslope by pipe must be constructed and restored under the direction of a Qualified Environmental Professional and a geotechnical engineer.

Council 5/3/2022 C-43-22 THAT coincident with final reading of Zoning Bylaw No. 900, 2014, Amendment Bylaw No. Bylaw No. 1093, 2022, a covenant be registered on the lands at 10 Erskine Lane for the following prior to issuance of a building permit to secure: 1. Provision of the following community amenity contributions prior to issuance of a building permit:
a. For the first 30 residential units: i. A concrete sidewalk along the south side of Erskine Lane from the intersection of Watkiss Way to the site and from the site to the trail connection to the Galloping Goose Regional Trail at the southern end of Erskine Lane, and ii. an upgraded trail connection between the southern end of Erskine Lane and the Galloping Goose Regional Trail. b. For additional residential units beyond the first 30 units, a community amenity contribution of $4,000 per residential unit. 2. AND THAT Development Permit Application No. 2022/04 include the following conditions:
1. Work in the development permit area is to be:
a. monitored by a Registered Professional Biologist;
b. conducted in accordance with the report titled “Environmental Review for 53 Knollwood Road, Victoria, BC” prepared by Fish-KW Environmental, dated April 12, 2022; and
c. concluded with a letter of completion from the Registered Professional Biologist indicating how the recommendations of the Environmental Review were met.
2. Areas where storm water is to be conveyed downslope by pipe must be constructed and restored under the direction of a Registered Professional Biologist and a geotechnical engineer;
3. Retaining walls and other slope stability works are to be designed by a geotechnical engineer, inspected and certified that they will be safe for the use intended in accordance with the “Proposed Retaining Walls & Pool” report prepared by Ryzuk Geotechnical dated November 16, 2021 with updated plans dated April 12, 2022; and
4. A security deposit for landscaping and protection of the natural environment must be provided prior to commencing alteration of land.
AND FURTHER THAT Development Permit Application No. 2022/04 include the following variances:
1. Variance to Section 4.8.9 of Zoning Bylaw No. 900, 2014 to vary the maximum permitted height of retaining walls from 1.2m to 2.0m; and
2. Variance to Section 4.8.10 of Zoning Bylaw No. 900, 2014 to vary the minimum height to horizontal separation ratio for unreinforced walls from 1:2 to 1:1.5.

Council 6/7/2022 C-61-22 THAT Temporary Use Permit No. 2022/01 at 2 Hospital Way be approved with the following conditions:
1. Prior to commencing the deposit of gravel:
a. A report from a geotechnical engineer is to be provided prior to commencing the deposit of gravel to provide recommendations on the proposed use of the site and to confirm that the site is safe for the use intended; and
b. A $5000 road cleaning deposit is to be provided;
2. The Director of Engineering may require a paved apron to reduce the potential for soil migration and damage to the roadway;
3. The Director of Engineering may require a wheel wash if dust, mud or other nuisance materials are tracked onto the roadway;
4. No vehicular parking or equipment / material laydown is permitted within Statutory Right of Way 305909G, and that delineation and protection of this Statutory Right of Way is done to the satisfaction of the Capital Regional District;
5. No work within the public road allowance is authorized by this permit; and
6. A soil permit is required for the deposit of more than 20 cubic meters of soil within a twelve-month period.

Council 6/21/2022 C-62-22 THAT, in response to Rogers Communications’ proposed 33.0-metre tall monopole tower at the BC Housing Management Commission’s property located at 94 Talcott Road, the Town provide a letter of land use concurrence to Innovation, Science and Economic Development (ISED) Canada noting that:
- the Town is satisfied with Rogers’ consultation process, as outlined in ISED’s Default Public Consultation Process;
- the proposed design and location are acceptable; and
- the Town has been consulted and concurs with the tower location;
AND THAT, as the Town no longer receives a grant for the property at 94 Talcott Road, the Mayor write to the BC Housing Management Commission to request the Town be provided with a portion of the monopole tower lease revenue.

Council 6/21/2022 C-66-22 THAT the Town of View Royal participate in the Capital Regional District led Regional Public Electric Vehicle Charging Network project grant application to the Investing in Canada Infrastructure (ICIP) CleanBC Communities Fund grant program; AND THAT the Town of View Royal supply sites found in Attachment 1 of the June 9, 2022 Committee of the Whole report from the Senior Planner titled “Regional Public Electric Vehicle Charging Network Project Grant Application” to install four level 2 public EV charging stations. Council 7/19/2022 C-68-22 THAT Development Variance Permit No. 2022/02 for 280 Island Highway be approved as per the July 13, 2022 report from the Senior Planner;
AND THAT Development Variance Permit No. 2022/02 include the following variances to requirements of Zoning Bylaw No. 900, 2014:
1. variance to the required number Class 1 (secure and covered) bicycle parking spaces within Section 5.5.1 of the bylaw from 37 to 24; and
2. variance to the required width of maneuvering aisles in an underground parking area within Section 5.7 of the bylaw from 6.7m to 5.5m.

AND THAT Development Permit 2021/18 include the following variances: Development Permit 2021/08 to requirements of Zoning Bylaw No. 900, 2014:
1. Variance to the maximum the height of a retaining wall from 1.2m to 2m (Section 4.8.9)
2. Variance to the retaining wall vertical height to horizontal spacing from 1:1 to 1:0.75 (Section 4.8.10)
3. Variance to the front lot line setback from 6m to 5.5m (Section 13.23.1)
4. Variance to the rear lot line setback from 6m to 5.4m (Section 13.23.1)
5. Variance to the south side lot line setback from 4.5m to 4.1m (Section 13.23.1);
AND FURTHER THAT Development Permit 2021/18 include the following conditions:
1. Roof top mechanical units are to be visually screened.

3. A security deposit for hard and soft on-site landscaping is required prior to building permit issuance.
4. Environmental impacts and mitigation measures including steep slope and interface fire hazard management be implemented in accordance with Development Permits 2019/02 and 2020/10.
5. The security deposit of $50,000 provided in Development Permit No 2019/02 to address any unsafe conditions or damage to the natural environment will apply to the works authorized in this development permit.

Council 9/6/2022 C-77-22 THAT Development Permit Application No. 2022-02 be approved as per the August 29, 2022, report from the Community Planner titled “Development Permit (Mixed Residential) 2022-02 – 167, 169, & 171 Island Highway”;
AND THAT Development Permit Application No. 2022-02 include the following conditions:
1. Tree Permit: a. A Tree Permit be submitted prior to Building Permit that follows the Arborist Report provided by Talmack Urban Forestry, titled: “167, 169, & 171 Island Hwy, View Royal, BC: Construction Impact Assessment & Tree Management Plan; and
2. A security deposit of $338,112.00, at 120% of the quoted landscape works ($281,760.00) to be provided
3. That the owner, enter into an agreement with the Town of View Royal via a Licence to Occupy that allows access from the subject property from the rear property line to the edge of the existing path. The agreement shall stipulate that access is to be maintained by the Strata and the operation and use of such a path will indemnify the Town of any responsibility or liability.
4. That as part of the Building Permit application process, the following be provided prior to or at the time of Building Permit application: a. Stormwater Management Plan, b. Servicing Plans, c. Structural Engineered design, stamp, and approval of suspended parkade structure to hold the Town of View Royal’s fire truck fleet, d. Confirmation from a geotechnical engineer that the foundation work will not affect neighbouring properties, due to the proximity of the foundation walls to property line.
AND FURTHER THAT Development Permit Application No. 2022-02 include the following variances:
1. Variance to Section 4.8.9 of Zoning Bylaw No. 900, 2014 to vary the maximum permitted height of retaining walls from 1.2 m to 3.0 m.
2. Variance to Section 3.7.2 (b) of Zoning Bylaw No. 900, 2014 to vary the maximum a balcony/open porch may project into the side yard setback from 0.5 m to 1.1 m.
3. Variance to Section 3.7.2 (b) of Zoning Bylaw No. 900, 2014 to vary the maximum width of a balcony may be on a building face from 2.0 m to 9.2 m.
4. Variance to Section 4.6.2 (c) of Zoning Bylaw No. 900, 2014 to permit the location of an accessory building or other structure in the front yard.
5. Variance to Section 5.10 (Table 5.2) of Zoning Bylaw No. 900, 2014 to vary the minimum number of required parking spaces from 93 to 92.
