8.1 STAFF REPORTS

a) Development Permit 2024-01 – 2001-2014 West Park Lane – Phase 6

1. Report dated May 15, 2024 from the Senior Planner The Senior Planner gave a summary of the report to Council. Council and staff discussed sidewalks, siting of townhouses, capacity, and roof pitch.

C-82-24 THAT Development Permit 2024-01 be approved as per the report dated May 15, 2024 from the Senior Planner titled “Development Permit 2024-01 – 2001-2014 West Park Lane – Phase 6”;

AND THAT Development Permit 2024-01 be issued upon receipt of a technical memorandum sealed by a Professional Engineer to confirm that the servicing demand for this phase and future phases is consistent with the original servicing plan, and this phase does not cause the original system to be over capacity. CARRIED

b) Alternatives to Car Share Program at 9 Erskine Lane

1. Report dated May 16, 2024 from the Senior Planner The Senior Planner reviewed the report for Council. Council and staff discussed bylaw requirements for bike charging in multi-family buildings and the logistics of these proposed bike share and bus pass program extensions.

C-83-24 THAT as an alternative to provision of a car share as per sections 8 and 9 of Covenant CA8718173 registered on title concurrently with the rezoning of 9 Erskine Lane, Council accept a $175,000 security deposit from the applicant for the following:

1. $30,000 towards the extension of the secured residential bike share program for two additional years; and
2. $145,000 towards the extension of the secured residential bus pass program until the remaining funds have been fully allocated;

AND THAT the security deposit be administered by the Director of Development Services. CARRIED

C-84-24 THAT Election Procedures Bylaw No. 989 and Sign Bylaw No. 950 be amended to remove provisions for candidates’ election signs on Town of View Royal land and instead allow for only federal, provincial, or local government signs that announce an upcoming election on Town of View Royal land. CARRIED Councillors Lemon and Rogers opposed

C-85-24 THAT Council specify and recommend potential changes to the Grant in Aid policy. CARRIED

A Council member asked what the likelihood of accessible units being built was in the proposed allocated floor area, and the ability to attract long-term families to the community if quality missing middle housing with amenity space is not created.

Council discussed affordability and what components comprise square footage.

C-86-24 THAT staff prepare the necessary bylaw amendments that would include the recommendations in the Standing Committee Report prepared by Standing Committee on Housing members titled “Implementing Small-Scale, Multi-Unit Housing in View Royal” (Option 3) as well as Schedule D: Garden Suite Regulations and Option 1 Schedule E: Small-Scale, Multi-Unit Housing Regulations attached to the staff report dated May 7, 2024 from the Senior Planner titled “Small-Scale Multi-Unit Housing – Proposed Zoning Regulations and Amendments to the Official Community Plan”. CARRIED Councillor MacKenzie opposed

Council discussed the buffered bike lanes on both sides of Helmcken Road, access and egress, pedestrian safety at the crosswalk, and consultation with the District of Saanich.

C-87-24 THAT staff proceed to the detail design for a “Modified Option CO2” concept that includes the removal of the southbound Helmcken Road pinch point, removal of the merge lane on the northbound leg of the intersection, and the installation of buffered bike lanes on both sides of Helmcken Road;

AND THAT staff monitor traffic impacts of the upcoming Ministry of Transportation and Infrastructure Bus on Shoulder Project to inform on future concepts for future Helmcken Road upgrades (ATNP Action Item 1C and 1D). CARRIED

1. Report dated May 1, 2024 from the Director of Protective Services The Director of Protective Services gave a summary of the report to Council, and indicated that the times noted in Schedule 10 of the Noise Control Bylaw should be amended from 9:00 p.m. to 9:00 a.m.

Council discussed measuring sound, potential for escalating fines, complaint process, and enforcement timelines.

C-88-24 THAT the information provided by Councillor Rogers at the May 21, 2024 Council meeting regarding lot coverage provisions for Option 3 Small-Scale Multi-Unit Housing be referred to staff for consideration in the Zoning Bylaw updates. CARRIED Councillor MacKenzie opposed

12. QUESTION PERIOD

a) K. Porter, Prince Robert Lane, questioned whether the Small Scale Multi-Unit Housing (Option 3) proposed by the Standing Committee on Housing Legislation and supported by Council through its vote this evening is too restrictive. He further wondered whether through this decision, the Town risks losing more control to the Province who will insert themselves into the Town’s operations. Mr. Porter stated no townhouses would be built due to the size limitation and that four houses can not be put onto many lots in the Town without demolition of the existing house. He hopes the bylaw will be tweaked to be less restrictive. He observed that this Standing Committee on Housing Legislation was heavily weighted to one demographic.
