    THAT Development Variance Permit No. 2019/03 for 29 Brigadoon Place be approved;

    AND THAT Development Variance Permit No. 2019/03 include the following variances:

    1. variance to Section 5.14 of Subdivision and Development Bylaw No. 985, 2017 to not require that power services be provided, located and constructed underground;

    2. variance to Section 5.16 of Subdivision and Development Bylaw No. 985, 2017 to not require that telecommunication services be provided, located and constructed underground; and

    3. variance to Section 4.6.4 of Zoning Bylaw No. 900 to permit the siting of a heat pump in the front yard.

    Staff Recommendation:

    THAT the Town of View Royal meet with BC Transit to establish an agreement for the purpose of moving the BC Transit handyDART project at 2401 Burnside Road West forward despite the P-3 (Parks and Recreation) land use zone designated for this property.

    8.2 COMMITTEE OF THE WHOLE RESOLUTIONS

    1. Financial Planning Process and Calendar THAT the Committee recommend to Council that the proposed 2020-2024 Financial Planning Calendar be approved. (COW-32-19)

    2. Referred Council Initiatives from December 2018 Committee of the Whole Meeting THAT the Committee recommend to Council that prior staff reports regarding heritage be provided to a future Committee of the Whole meeting. (COW-33-19)

    3. Pilot Energy Refit Program - Councillor Lemon THAT the Committee recommend to Council that the investigation into a potential pilot energy refit program be referred to staff. (COW-34-19)

    4. Rezoning - 1449 Burnside Road W. (Eagle's Nest) THAT the Committee recommend to Council that the rezoning application for 1449 Burnside Road W. (Eagle's Nest) be declined. (COW-35-19)

    5. Proposed Streets Bylaw No. 980, 2019 THAT the Committee recommend to Council that "residential parking permit zone" provision not be included in draft Streets Bylaw No. 980, 2019;

      AND THAT a provision be made to permit the use of skateboards, push scooters, strider bikes, rollerskates, and in-line skates on sidewalks in draft Streets Bylaw No. 980, 2019;

      AND THAT the boulevard parking provisions proposed in draft Streets Bylaw No. 980, 2019 regarding:

      • minimum shoulder width of 2.5m,
      • minimum clearance of 6.0m on the roadway, and
      • maximum encroachment into a roadway 30cm be utilized;

      AND THAT the Town's current Bylaw Enforcement Policy be followed with respect to existing, non-permitted boulevard encroachments/improvements;

      AND THAT proposed Streets Bylaw No. 980, 2019 be forwarded to the Community Development Advisory Committee for information;

      AND FURTHER THAT a public information open house be held on Monday, October 7, 2019. (COW-36-19)
