Introduction of Business License Bylaw No. 952, 2016 and Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016

RECOMMENDATIONS:

  1. THAT the June 29, 2016 report from the Senior Planner titled "Introduction of Business License Bylaw No. 952, 2016 and Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016" be received;
  2. AND THAT Business License Bylaw No. 952, 2016 be given first, second and third reading;
  3. AND THAT Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016 be given first, second and third reading;
  4. AND FURTHER THAT no additional notification of Business License Bylaw No. 952, 2016 be required, aside from regular bylaw notification.

PURPOSE OF REPORT:

  1. To introduce Business License Bylaw No. 952, 2016.
  2. To introduce Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016.
  3. To consider public notice requirements for Business License Bylaw No. 952, 2016.

BACKGROUND:

To help ensure that key bylaws reflect community needs, the View Royal Strategic Plan 2015-2018 identified the need for a review of the Business License Bylaw in 2016. The review was introduced at the May 10, 2016 Committee of the Whole meeting.

DISCUSSION:

1. Key points: Business License Bylaw No. 952, 2016

a. Upper limit of fine conviction raised from $2,000 to $10,000. Bringing cases to court is becoming more staff-intensive. This upper limit corresponds to that of the Township of Esquimalt. b. Introduce minimum license fee for apartments of $100. There would be no change to businesses renting an apartment of seven units or more. c. Added a home occupation classification, as Township pf Esquimalt does. Provides clarity for home occupation license applicants. d. Daily license classification added for craft fairs and other itinerant shows, similar to District of Saanich and others. This would accommodate "popup" events that can contribute to the local economy, culture, and community development.

2. Key Points: Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016

a. Updated references to Business License Bylaw No. 952, 2016

3. Notification of Business License Bylaw No. 952, 2016

The Community Charter requires Council to consider how notification of bylaw will be made and to provide opportunities for public comment prior to adoption of the bylaw. At this point no significant fee increases are proposed, so no extraordinary measures outside of the standard bylaw notification procedures are recommended.

RECOMMENDATIONS:

  1. THAT the June 29, 2016 report from the Senior Planner titled "Introduction of Business License Bylaw No. 952, 2016 and Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016" be received;
  2. AND THAT Business License Bylaw No. 952, 2016 be given first, second and third reading;
  3. AND THAT Municipal Ticket Information Bylaw No. 643, 2007 Amendment Bylaw No. 953, 2016 be given first, second and third reading;
  4. AND FURTHER THAT no additional notification of Business License Bylaw No. 952, 2016 be required, aside from regular bylaw notification.
